On November 11, 2023, several parents, on behalf of their minor children, brought this class action lawsuit against the acting commissioner of the New Jersey Department of Health and the assistant commissioner for the Division of Family Health Services. The plaintiffs alleged that the State of New Jersey collected blood samples of their infant children -- without parental consent -- to screen for a set of diseases and kept these samples for 23 years.  Moreover, the plaintiffs alleged that the defendants have the ability to use the blood in any way they sees fit, including by giving some blood to law enforcement officers without a warrant. The plaintiffs alleged that the retention of blood absent a warrant or informed consent violates the Fourth Amendment and Fourteenth Amendment Due Process. Represented by the Institute of Justice and a private law firm, the plaintiffs sought declaratory relief, class action certification, and an injunction that permanently enjoins the defendants from keeping or retaining any blood spots absent informed consent. 

The plaintiffs sought to certify two classes: 

  1. The children’s class made up of “all persons born in New Jersey on or after November 2, 2000, whose blood has been or will be retained by New Jersey’s newborn screening program absent parental consent”
  2. The parent’s class made up of “all parents or legal guardians of minors born in New Jersey on or after November 3, 2005, whose blood has been or will be retained by New Jersey’s newborn screening program absent parental consent.”

The case was heard by Magistrate Judge Rukhsanah L. Singh. 

After the suit was filed, the defendants unilaterally changed their policy in the summer of 2024. The defendants shortened the blood retention period from 23 years to either 2 years or 10 years (depending on whether the child was found to have a disorder). In addition, the defendants revised their handout about the newborn screening program, clarifying the goal of the program and offering additional resources for parents who want to learn more about the program. 

On August 2, 2024, the plaintiffs filed an amended complaint, adding additional facts to their allegations in response to the updated policy. 

Several months later, on November 15, the defendants filed a joint motion to dismiss for lack of standing and failure to state a claim.  The defendants alleged first that the plaintiffs did not have standing; plaintiffs could not demonstrate traceability because they never requested that their children not be tested. In addition, the defendants argued that their 2-year retention policy was reasonable under the Fourth Amendment. 

The court granted in part and denied in part the defendants' motion to dismiss on August 18, 2025. On the one hand, the court dismissed with prejudice the plaintiff’s request for an order requiring defendants to obtain parental consent before drawing blood from infants due to lack of standing. On the other hand, the court dismissed the defendants’ motion to dismiss in all other respects. The court administratively closed the case and gave the plaintiffs the opportunity to cure deficiencies through an amended complaint. 

In response, on October 8, 2025, the plaintiffs filed their second amended complaint, attempting to cure the deficiencies identified by the court earlier by adding additional evidence to support their allegations. In addition, the plaintiffs attempted to demonstrate future harm by illustrating how the plaintiffs intend to have more children, and they and their future children would be subject to the blood test policy again. 

This case is ongoing.
