Millions of Americans rely on the Supplemental Nutrition Assistance Program (SNAP) for food assistance. In light of the federal government shutdown, effective November 1, 2025, the U.S. Department of Agriculture (USDA) abruptly suspended SNAP benefits and terminated existing waivers of certain SNAP work-requirements months early. Because they allege “there are appropriated funds available that could—and must—be used for those [SNAP] benefits,” a national union of plaintiffs brought suit on October 30, 2025 in the U.S. District Court for the District of Rhode Island against the USDA, the Office of Management and Budget (“OMB”), and the U.S. Department of Treasury.

The plaintiffs in this action include SNAP recipients, cities, faith-based organizations and nonprofits that provide emergency food assistance, and food retailers that rely on SNAP-powered purchases. They alleged that the USDA’s suspension of SNAP benefits and premature termination of waivers for certain work requirements are unlawful, exceed the  agency’s statutory authority, and are arbitrary and capricious, in violation of the Administrative Procedure Act (“APA’). They sought declaratory and injunctive relief that would provide immediate reinstatement of SNAP benefits and reverse the early termination of work waivers under SNAP. The case was assigned to Chief Judge John James McConnell Jr. 

The same day the complaint was filed, the plaintiffs also filed a motion for Temporary Restraining Order (“TRO”) to prevent the SNAP benefit termination and recission of work waivers from going into effect. On October 31, the court held a hearing for the TRO Motion. It ordered the USDA to honor the existing work waivers, and either (1) provide full SNAP benefits, or (2) provide only partial benefits no later than November 5, 2025, and “expeditiously resolve the administrative and clerical burdens [they] described in [their] papers.” The USDA was also ordered to report to the Court on Monday, November 3, 2025, regarding the status of the distribution. 2025 WL 3050100.

On November 3, the USDA filed a status report detailing its choice to use its discretion to provide only partial SNAP benefits. The USDA stated it would provide notice to states on how to calculate partial benefits the same day, but “the system changes States must implement to provide the reduced benefit amounts will take anywhere from a few weeks to up to several months.”

In response, the plaintiffs filed a motion to enforce the court’s November 1 TRO on November 4, 2025. Because the USDA represented that it would be unable to issue partial payment of SNAP benefits by November 5, the plaintiffs sought an order from the court compelling the USDA to release the withheld funding, in its entirety, for November SNAP benefits. 

Later the same day, the plaintiffs filed supplemental notice to advise the Court of a Truth Social post that the President posted that morning after plaintiffs filed their motion to enforce the TRO. The plaintiffs alleged that this post “confirms that Defendants are holding full SNAP benefits hostage for political leverage during the shutdown.” In the post, President Trump stated: SNAP BENEFITS, which increased by Billions and Billions of Dollars (MANY FOLD!) during Crooked Joe Biden’s disastrous term in office (Due to the fact that they were haphazardly “handed” to anyone for the asking, as opposed to just those in need, which is the purpose of SNAP!), will be given only when the Radical Left Democrats open up government, which they can easily do, and not before!

On November 6, 2025, the court granted the Plaintiffs’ Motion for Enforcement and issued a second TRO, requiring the full payment of SNAP benefits to be made immediately. 2025 WL 3111213. The court found that the USDA’s decision to provide only partial benefits, while knowing that the novel system of partial payments would entrench delay, was arbitrary and capricious. Further, the court stated that the decision to withhold benefits was clearly for political purposes because it was “an outcome that predictably magnifies harm and undermines the very purpose of the program it administers.” In order to prevent the more than 42 million Americans who rely on SNAP benefits from going hungry, the court ordered the USDA to make “full payments of November SNAP benefits to the states by Friday, November 7, 2025, by utilizing available Section 32 funds in combination with the contingency funds.”

The same day, the Defendants appealed both of the court’s orders to the U.S. Court of Appeals for the First Circuit. The First Circuit denied the Government's motion for an administrative stay. 2025 WL 3124189, On an emergency appeal, the Supreme Court, specifically Justice Jackson, granted an administrative stay of the District Court's motion pending the appeal in the First Circuit. 2025 WL 3124183. The First Circuit denied the Government's request for a stay pending appeal on November 9, 2025, finding that the Government failed to meet its burden on any of the stay factors and, as a remedy for noncompliance with the October 31 TRO, the District Court likely had the authority to order the full SNAP benefit payments. Justice Jackson's administrative stay is set to expire on November 11, 2025.
