The Court reviewed the status reports 65 and 66 with the parties and discussed issues relating to the inspection the Broadview facility on 11/13/2025. By agreement, the Plaintiffs may bring five attorneys, one translator, and their disclosed expert. Plaintiffs will be permitted to take photographs during the visit. Those photos must be shared with Defendants and held attorneys' eyes only until Defendants have had an opportunity to review the photos and the parties have conferred regarding whether any photographs should be redacted or blurred. By agreement, Plaintiffs' counsel and their expert will be permitted to speak with putative class members regarding the issues presented in this litigation, but those individuals will not be compelled to speak with counsel. Given timing and logistics, some conversations between counsel and putative class members might need to occur later by telephone. Plaintiffs' counsel will be permitted to leave contact information with putative class members. Defendants have agreed to provide a log of detainees presently held in Broadview to counsel on 11/13/25. Other topics regarding scope and duration of the visit will be addressed on 11/13/25, as discussed on the record. The parties are continuing to confer on the scope of an agreed protective order, as well as on timing for the completion of expedited fact discovery for use at the preliminary injunction hearing. Turning to expert discovery, any party intending to offer affirmative retained expert opinion at the preliminary injunction hearing must serve Rule 26(a)(2)(B) disclosures on 12/3/25. Rebuttal expert disclosures must be served by 12/10/25. Expert depositions must be completed before 12/17/25. ORDER GENERAL ORDER 25-0028: RESETTING OF DEADLINES IN CIVIL MATTERS INVOLVING THE UNITED STATES AS A PARTY IT APPEARING THAT as a result of the partial federal government shutdown, this Court amended General Order 25-0024 suspending as of October 1, 2025, all civil litigation in which the United States of America, its agencies, its officers, or employees were parties, with the stated intention of clarifying schedules in such cases upon the expiration of the lapse in appropriations; and IT FURTHER APPEARING THAT appropriations having been restored to fund the Department of Justice and other Executive Branch agencies, with employees beginning to report for work beginning on November 13, 2025; accordingly IT IS THEREFORE ORDERED that the stay entered by General Order 25-0024 is hereby lifted, and any and all deadlines in affected civil cases (whether established by order, rule, or agreement.), including but not limited to any scheduled discovery and pleading dates, are extended by 49 days. The Court warns litigants that this General Order does not purport to affect rights to or deadlines concerning appeal from any decision of this Court. Any litigant affected by this General Order may seek relief from the order by motion. Trial dates in the affected cases will stand, although they may need to be adjusted in individual cases to account for the extension of other dates. MINUTE entry before the Honorable Laura K. McNally: The Court has reviewed the Joint Status Report 92 . As described by both sides, the sole remaining issue regarding the confidentiality order relates to how Defendants are obliged to treat certain materials produced by Plaintiffs. The parties also report that Defendants have materials that they are prepared to produce to Plaintiffs, subject to entry of the confidentiality order. Given that the disputed term of the confidentiality order will have no impact on Defendants' production to Plaintiffs, Defendants are ordered to produce their responsive materials forthwith, subject to the other terms already agreed to by the parties. The Court understands that Defendants are also seeking additional time for certain materials 89, but the rolling production of presently-available materials, as represented both in the status report and to Judge Gettleman on 11/18/25, must begin instanter.
