On October 30, 2025, Plaintiffs—immigration detainees at Broadview detention center—brought this suit in U.S. District Court for the Northern District of Illinois against ICE, DHS, and their respective leadership. Filing as representatives of a proposed class, Plaintiffs alleged that the Broadview ICE Facility—a short-term holding site outside Chicago—had been transformed into an illegal, inhumane detention center where hundreds are held for days or weeks under unsanitary, overcrowded, and abusive conditions. These changes came in the wake of "Operation Midway Blitz," a mass detention campaign targeting the Chicago area. While Broadview was intended to be a temporary holding facility, Plaintiffs alleged that detainees are warehoused for days on end without adequate access to food, water, or other basic amenities, pursuant to DHS and ICE policy. Plaintiffs sought injunctive and declaratory relief under the First and Fifth Amendments as well as the Administrative Procedure Act in order to restore access to counsel and challenge the inhumane confinement of detainees.

The case was assigned to Judge Robert W. Gettleman, along with Magistrate Judge Laura K. McNally. Along with their complaint, Plaintiffs filed for a Temporary Restraining Order (TRO), requesting that the court remedy the ongoing Constitutional violations. Likewise, Plaintiffs filed a motion for class certification the same day.

The following morning, on October 31, 2025, the ICE locator indicated that one of the named Plaintiffs' locations had changed to Greene County Jail in Springfield, Missouri. At the time, counsel were unable to determine whether said Plaintiff had been transferred. Plaintiffs filed an emergency motion mandating attorney access to Broadview and that the individual named plaintiffs remain in or be returned to the Seventh Circuit. Plaintiffs also requested that the Court issue an order prohibiting the Plaintiffs’ transfer outside the Seventh Circuit.

On November 5, 2025, the court granted Plaintiffs' TRO, finding the balance of equities to tip in favor of the named Plaintiffs and the proposed class. Judge Gettleman ordered that Defendants immediately provide all persons detained at Broadview with at least three full meals per day, adequate supplies of soap, towels, toilet paper, oral hygiene products, prescribed medication, telephone services for access to family and counsel, and a list of  pro bono attorneys in English and Spanish. The court further ordered that all detainees being held overnight must be furnished with a clean bedding mat and bedding with sufficient space to
sleep. The order was set to remain in effect until November 19, 2025.

By agreement, the Plaintiffs may bring five attorneys, one translator, and their disclosed expert. Plaintiffs will be permitted to take photographs during the visit. Those photos must be shared with Defendants and held attorneys' eyes only until Defendants have had an opportunity to review the photos and the parties have conferred regarding whether any photographs should be redacted or blurred. By agreement, Plaintiffs' counsel and their expert will be permitted to speak with putative class members regarding the issues presented in this litigation, but those individuals will not be compelled to speak with counsel. Given timing and logistics, some conversations between counsel and putative class members might need to occur later by telephone. Plaintiffs' counsel will be permitted to leave contact information with putative class members. Defendants have agreed to provide a log of detainees presently held in Broadview to counsel on 11/13/25. Other topics regarding scope and duration of the visit will be addressed on 11/13/25, as discussed on the record. The parties are continuing to confer on the scope of an agreed protective order, as well as on timing for the completion of expedited fact discovery for use at the preliminary injunction hearing. Turning to expert discovery, any party intending to offer affirmative retained expert opinion at the preliminary injunction hearing must serve Rule 26(a)(2)(B) disclosures on 12/3/25. Rebuttal expert disclosures must be served by 12/10/25. Expert depositions must be completed before 12/17/25. If the parties agree to extend the temporary restraining order and reset the preliminary injunction hearing, the Court will be willing to modify these dates. As described by both sides, the sole remaining issue regarding the confidentiality order relates to how Defendants are obliged to treat certain materials produced by Plaintiffs.
