On November 3, 2025, plaintiffs, including the National Council of Nonprofits and various cities and counties, filed suit against the U.S. Department of Education in U.S. District Court for the District of Massachusetts. They allege that Defendants have now promulgated a Rule that purports to allow the Secretary of Education to selectively disqualify employers from participation in Public Service Loan Forgiveness on the Secretary’s determination that an employer has engaged in activities with a purported “substantial illegal purpose.”
