This case challenges the administration’s alleged political retaliation against democratic states by terminating government grants for environmental programs. 

The day before the government shutdown took effect, President Trump had announced that the government “can do things during the shutdown” that are “bad for” Democrats and “irreversible,” such as “cutting programs that they like.” On the first day of the shutdown, October 1, 2025, the Department of Energy mass terminated hundreds of clean-energy grants and cooperative agreements worth roughly $7.5 billion in sixteen states. 

On November 10, 2025, six plaintiffs – grantees, subgrantees, and organizations affiliated with terminated awards – filed this suit in the U.S. District Court for the District of Columbia against the Department of Energy (DOE), Secretary Christopher Wright, the Office of Management and Budget (OMB), and Director Russell Vought. Plaintiffs alleged the cuts were made to punish the sixteen states that voted for Vice President Harris in the 2024 election, and that are represented by two Democratic senators. The plaintiffs claimed that the terminations violated (1) the First Amendment’s prohibition on viewpoint discrimination by targeting political speech and association and (2) the Fifth Amendment’s equal protection guarantee. Plaintiffs sought declaratory and injunctive relief. 

The plaintiffs subsequently filed a motion for preliminary injunction. They alleged that delayed relief would lead to irreparable harm because, unless the grant awards are restored imminently, they would be required to shut down these projects permanently. 

This case is ongoing.
