Case Summary

On November 11, 2025, Plaintiff, a U.S. importer, filed this lawsuit against U.S. Customs and Border Protection, Rodney S. On November 11, 2025, Plaintiff, a U.S. importer, filed this lawsuit against U.S. Customs and Border Protection, Rodney S. Scott, and the United States in the U.S. Court of International Trade in order to challenge a series of 2025 executive orders through which President Trump imposed sweeping new tariffs under the International Emergency Economic Powers Act (IEEPA). Beginning February 1, 2025, the President issued multiple orders imposing “Trafficking Tariffs” on imports from Mexico, Canada, and China based on alleged national emergencies tied to drug trafficking and illegal immigration. These were followed by a “Reciprocal Tariff Order” imposing a baseline 10% tariff on almost all imports and dramatic country-specific tariff hikes, including increases that pushed Chinese imports over 145% duty.

Plaintiffs alleged that IEEPA does not authorize tariffs, citing the Federal Circuit’s en banc decision in V.O.S. Selections v. Trump, which held the same tariff orders unlawful. Plaintiffs sought a declaration that all IEEPA-based tariffs are unlawful, an injunction halting further tariff collection, and refunds of all duties already paid, plus protection from liquidation while litigation proceeds.

Over the course of the following several months, Plaintiffs filed four subsequent motions to consolidate this lawsuit with nearly five dozen others, including Mazak Corporation v. United States, Standex Scientific Solutions v. U.S. Customs and Border Protection, and Pulse Wire & Cable LLC v. United States Customs and Border Protection. Each case was filed by an American importer against the Trump administration, and each contained a near-identical cause of action and prayer for relief. The Clearinghouse is tracking those cases [here.] The court granted the first three unopposed motions on November 19, December 3, and December 8, respectively.

Meanwhile, on November 20, Plaintiffs filed for preliminary injunction suspending liquidation of Plaintiffs entries for which duties were paid pursuant to the IEEPA Tariff Orders. The parties reiterated the primary arguments of their complaints; each named plaintiff is an importer of record who paid tariffs pursuant to the 2025 executive orders, the entries for which will begin to liquidate on or after December 15, 2025. The motion further detailed that, while Defendants opposed the injunction, Plaintiffs and the U.S. Department of Justice were nonetheless discussing a potential stipulation regarding the ultimate disposition of IEEPA tariff payments made pending the Supreme Court's decision in V.O.S. Selections v. Trump.

The court denied Plaintiffs' preliminary injunction in a slip opinion on December 15, 2025. A three-judge panel comprised of Judges Gary S. Katzmann, Timothy M. Reif, and Jane A. Restani, held that Plaintiffs could not demonstrate irreparable harm resulting from liquidation pending a final decision in V.O.S. The opinion highlighted the Government's response to Plaintiffs’ motion, in which it “[has] made very clear—both in this case and in related cases—that [it] will not object to the [c]ourt ordering reliquidation of plaintiffs’ entries subject to the challenged IEEPA duties if such duties are found to be unlawful."

On December 23, 2025, the Court of International Trade issued an order to stay the case pending a final, unappealable decision in V.O.S. Selections, Inc. v. Trump.
