On November 17, 2025, the United States government sued the State of California and California Governor Gavin Newsom, over two recently enacted state laws. In their complaint, the U.S. asserted that California's No Secret Police Act and No Vigilantes Act improperly regulated the federal government by dictating permissible uniforms for federal agents and forcing federal agencies to adopt specified policies. The federal government argued that both laws violated long-settled principles of the Supremacy Clause, under which states have no power to “in any manner control[] the operations of” the federal government, and sought declaratory and injunctive relief, costs, and fees. The lawsuit was filed in the U.S. District Court for the Central District of California and assigned to Judge Christina A. Snyder. 

On November 25, 2025, the United States moved for a preliminary injunction to halt the enforcement of the relevant portions of each of the acts at issue. As to the No Secret Police Act, the U.S. challenged section 3 and section 2, which prohibited federal law enforcement from wearing face coverings and required the adoption of certain written rules, respectively.  With respect to the No Vigilantes Act, the U.S. challenged sections 10 and 2, which required non-uniformed officers to wear identification and adhere to specific written identification rules. The federal government asserted that those provisions violated the Supremacy Clause by attempting to regulate federal officers' uniforms and the internal policies of federal agencies. The motion further argued that the No Secret Police Act was discriminatory because it applied these restrictions to federal agents but not to California's own state law enforcement officers, that prohibiting federal agents from masking their identities "recklessly endangers" them, and that the challenged restrictions compromised the effectiveness of sensitive law enforcement activities.
