This case challenges the recent Department of Homeland Security (DHS) policy, issued on July 8, 2025, that instructs Immigration and Custom Enforcement (ICE) employees to consider anyone who has entered the U.S. without inspection as subject to mandatory detention and edible for release only on parole. Under section 1226(a) of the Immigration and Nationality Act (INA),  individuals who have been detained by ICE after entering and residing in the U.S. were granted bond or conditional parole hearings before an immigration judge to determine whether they can be released awaiting resolution of their removal proceedings. However, those who have been detained at the border on arrival to the U.S., as per section 1225(b)(2), were subject to mandatory detention.  

The plaintiffs in this case are a group of noncitizens that have lived in the U.S. for years but entered the U.S. without inspection and are being detained at the Adelanto Immigration and Custom Enforcement Processing Center following  immigration raids and enforcement actions In Los Angeles. These plaintiffs were denied an opportunity for a bond hearing. They filed an initial petition for a writ of habeas corpus that was amended on July 28 to include class action complaint against DHS and Kristi Noem, Attorney General Pamela Bondi, The Executive Office for Immigration Review and their Director, the Adelanto Immigration Court, ICE, the Acting Director of the United States Center for Immigration Services (USCIS), the ICE Field Office Director and the Warden of the Adelanto ICE Processing Center. They alleged that the DHS policy violated the Administrative Procedure Act because it was arbitrary and capricious, contrary to law, and DHS failed to observe the required procedures. Additionally, plaintiffs alleged that DHS has unlawful denied their release on bond under the Immigration and Nationality Act, violated Federal Bond Regulations, and their due process rights. Represented by the ACLU and the Northwest Immigration Rights Project, the plaintiffs sought declaratory and injunctive relief and a writ of habeas corpus in the U.S. District Court for the Central District of California. The plaintiffs also sought to represent the following two classes: 

  • The Bond Eligible Class: “All noncitizens in the United States without lawful status who (1) have entered or will enter the United States without inspection; (2) were not or will not be apprehended upon arrival; and (3) are not or will not be subject to detention under 8 U.S.C. § 1226(c), § 1225(b)(1), or § 1231 at the time DHS makes an initial custody determination”
  • The Adelanto Class: “All noncitizens in the United States without lawful status who (1) have or will have proceedings before the Adelanto Immigration Court; (2) have entered or will enter the United States without inspection; (3) were not or will not be apprehended upon arrival; and (4) are not or will not be subject to detention under 8 U.S.C. § 1226(c), § 1225(b)(1), or § 1231 at the time the noncitizen is scheduled for or requests a bond hearing.”

This case was assigned to Judge Sunshine Suzanne Skyes. The plaintiffs subsequently sought a temporary restraining order which the court granted on July 28. 2025 WL 2670875. The court found that plaintiffs were entitled to a bond hearing under section 1226(a) because its regulations provide extensive procedural protections unavailable under other detention provisions. In doing so they rejected the government’s argument that plaintiffs fall under section 1225 because they are “applicants for admission.” The court also agreed with plaintiffs that going back to the Board of Immigration Appeals would be futile, that further detention constitutes irreparable injury, and agency delay in adjudicating bond appeals warrants excusing exhaustion.

On August 11, the plaintiffs moved for class certification of the Bond Eligible Class and the Adelanto Class. They also filed a motion for partial summary judgment given that the case concerned a legal determination of whether section 1225 or section 1226(a) applied. The statutory construction and long-standing practice dictate that section 1226(a) applies here. In support of plaintiffs’ motion, 19 states and the District of Columbia filed an amicus brief. 

On September 11, 2025, the court denied plaintiffs motion for preliminary injunction because the named plaintiffs in this case were provided with an individualized bond hearing and subsequently released on bond. 2025 WL 2624433. In their response, the government opposed class certification because it claimed that every detained immigrant must file their own individual habeas petition. The government also opposed the partial summary judgment motion because they claimed that the court lacked jurisdiction over these immigration proceedings and that plaintiffs’ mandatory detention is governed by section 1225(b) which includes all “applicants for admission.”

On November 20, the court granted plaintiffs’ motion for partial summary judgment and denied the request to enter final judgement. 2025 WL 329861. The court first established justiciability because no part of the statute deprived the court of jurisdiction over this matter and there have not been any orders of removal issued that would be barred from review. Their petition was not moot because they face the real risk of re-arrest and mandatory detention because of the government's continued immigration raids that have resulted in individuals being subject to mandatory detention. The court flatly rejects the government’s claim that this matter is governed by section 1225 because “[I]ndividuals who have not been inspected and authorized by an immigration officer lack the trait to be categorized as ‘applicant for admission.’” Those individuals fall under section 1226. Whereas the government’s broad interpretation would effectively nullify a portion of the INA. 

Five days later, the court granted the plaintiffs’ class certification motion for only the nationwide Bond Eligible Class (which the parties had previously agreed to, given the redundancy). 2025 WL 3288403. The court found that the plaintiffs’ fulfilled the class requirements given that the thousands of individuals who entered the U.S. without inspection are now being detained every day by ICE, and being deprived of their right to a bond hearing. Any factual differences about their entitlement to release were distinct from the relief that would be offered in this case — the right to an individualized hearing.  

On December 4, 2025, Petitioners filed an Application for Clarification and Reconsideration, detailing the ways that the respondents had “persisted in denying class members bond hearings" and asking the court to appoint additional class counsel, reconsider or clarify the class certification order as to final or binding classwide declaratory relief, direct entry of final judgment, and expressly confirm that the ruling on summary judgment declared and vacated the challenged agency action. 

On December 18, 2025, the court granted the application in part. First, it added additional class counsel as requested. It also clarified that its prior ruling on the motion for summary judgment encompassed Count III of the Amended Class Complaint and granted classwide vacatur of the unlawful DHS policy. Finally, reasoning that entry of final judgment would aid expeditious decision of the case and noting that the motion for class certification was no longer pending, the court entered final judgment as to counts I, II, and III of the amended class complaint.  In a judgment issued that same day, the court therefore entered judgment in favor of the petitioners and the Bond Eligible Class as follows:

  • A declaration that the Bond Eligible Class members were detained under 8 U.S.C. § 1226(a) and not subject to mandatory detention under § 1225(b)(2);
  • A declaration that, pursuant to defendants' regulations, the Bond Eligible Class members were detained under 8 U.S.C. § 1226(a), are not subject to mandatory detention under § 1225(b)(2), and are entitled to consideration for release on bond by immigration officers and, if not released, a custody redetermination hearing before an immigration judge;
  • Vacatur of the DHS policy described in the July 8, 2025, “Interim Guidance Regarding Detention Authority for Applicants for Admission” under the Administrative Procedure Act as not in accordance with law; and
  • Entry of final judgment as to Claims I, II, and III of the Amended Class Complaint, and certification of those claims for appeal.

Defendants filed a notice of appeal that same day; appeal is pending.
