Case Summary

On November 28, 2025, Plaintiff, a U.S. importer subjected to the challenged duties, brought this lawsuit in the U.S. Court of International Trade against U.S. Customs and Border Protection and its commissioner, as well as the United States, in order to challenge a suite of unlawful Trump Administration tariff orders. The "IEEPA orders" dramatically raised the cost of machinery and components sourced globally, pursuant to a series of 2025 executive orders issued by the Trump administration. Plaintiff argued that the President’s attempts to justify tariffs through drug-trafficking-related emergencies or trade-deficit emergencies exceeded statutory and constitutional limits. Plaintiff requested declaratory and injunctive relief, plus refunds of all unlawfully collected tariffs.

This case is one of several dozen that were consolidated with AGS Company Automotive Solutions v. United States Customs and Border Protection, the lead case regarding IEEPA duty liquidation as of December 3, 2025. On December 23, that case was stayed pending the Supreme Court's decision in V.O.S.
