On December 1, 2025, Plaintiff, a U.S. importer subjected to the challenged duties, brought this lawsuit in the U.S. Court of International Trade against U.S. Customs and Border Protection and its commissioner, as well as the United States, in order to challenge a suite of unlawful Trump Administration tariff orders. The "IEEPA orders" dramatically raised the cost of machinery and components sourced globally, pursuant to a series of 2025 executive orders issued by the Trump administration. Plaintiff argued that the President’s attempts to justify tariffs through drug-trafficking-related emergencies or trade-deficit emergencies exceeded statutory and constitutional limits. Plaintiff requested declaratory and injunctive relief, plus refunds of all unlawfully collected tariffs.
This case is ongoing. It followed V.O.S. Selections v. Trump, and will likely be subject to the Supreme Court's February 20, 2026 decision ruling that IEEPA does not authorize the President to impose broad, unilateral tariffs.
