This case challenged the government’s retention and warrantless searching of a complete forensic image of a private citizen’s personal computer after the dismissal of a related criminal prosecution. On November 26, 2025, Daniel Richman, a law professor and confidant of former FBI Director James Comey, filed a motion for return of property under Federal Rule of Criminal Procedure 41(g) in the U.S. District Court for the District of Columbia. Richman alleged that the government violated the Fourth Amendment by retaining and searching a complete copy of his personal computer and related account data without a warrant after the conclusion of earlier investigations and following the dismissal of charges against Comey. He sought an order requiring the government to return or delete the seized materials so that they could not be used in any future proceedings.

The government had originally obtained an image of Richman’s computer in 2017 pursuant to limited consent to identify and remove four memoranda authored by Comey. In 2019 and 2020, the government obtained four search warrants authorizing searches of the computer image, Richman’s Columbia University email accounts, and his Apple iCloud account. Those warrants permitted seizure of only limited categories of information. The court later found that the government failed to segregate responsive materials from nonresponsive materials and retained unscoped copies of Richman’s data. In 2025, during a renewed investigation of Comey, the government conducted a warrantless search of those retained materials.The matter was assigned to District Judge Colleen Kollar-Kotelly.

On December 6, 2025, the court granted in part and deferred in part Richman’s motion for a temporary restraining order. The court concluded that Richman was likely to succeed on the merits of his claim that the government violated the Fourth Amendment by retaining a complete forensic image of his personal computer and searching that image without a warrant. 2025 WL 3505458. The court further found that Richman was likely entitled to return of the image under Rule 41(g), that continued retention constituted an ongoing unreasonable seizure causing irreparable harm, and that the balance of equities and public interest favored immediate relief. To preserve the status quo, the court ordered the government to identify, segregate, and secure all copies of Richman’s computer image, related email and iCloud data, and any materials derived from those files, and prohibited any access, dissemination, or disclosure absent leave of court. The court required the Attorney General to certify compliance by December 8, 2025, and ordered expedited briefing, with the temporary restraining order set to expire on December 12, 2025, absent further order.

On December 12, 2025, the court issued a memorandum opinion granting Richman’s motion for return of property under Rule 41(g). 2025 WL 3611753. The court held that the government violated the Fourth Amendment by retaining complete copies of Richman’s devices long after execution of the warrants and by conducting a warrantless search of those materials in September 2025. The court concluded that the government’s conduct constituted both an unreasonable search and an ongoing unreasonable seizure, particularly given the lack of safeguards to prevent unauthorized access to privileged and highly personal materials. As equitable relief, the court ordered the government to return to Richman all copies of the computer image, files obtained from his email and iCloud accounts, and any materials derived from those files. Exercising its equitable authority, the court permitted the government to deposit a single sealed copy of the materials with the U.S. District Court for the Eastern District of Virginia, accessible only pursuant to a valid search warrant and court order.

The government subsequently filed emergency motions seeking clarification and modification of the December 12 order, arguing that the order improperly required destruction of lawfully obtained evidence and conflicted with record-retention and classification obligations.

On December 23, 2025, the court denied those requests in substantial part. 2025 WL 3718712. The court held that the government had no lawful basis to retain any copies of Richman’s data because it failed to segregate responsive materials when executing the 2019 and 2020 warrants and therefore could not rely on those warrants to justify continued possession. The court rejected the government’s request to lodge the materials with the Department of Justice’s Litigation Security Group or to create additional copies, reaffirming that only a single copy could be deposited with the Eastern District of Virginia. The court amended its prior order solely to clarify that the government could delete one document that had been up-classified after 2017 before returning the materials, but otherwise left the relief intact.

On December 27, 2025, the court issued a further order addressing enforcement and compliance. The court granted the government a limited extension of time, setting January 5, 2026 as the deadline for the Attorney General or her designee to certify compliance with the return-of-property order. However, the court denied the government’s request to conduct additional review of Richman’s materials for classified information without first obtaining a valid search warrant. The court reiterated that the government was prohibited from accessing, reviewing, disseminating, or disclosing Richman’s materials for any purpose other than deleting the single identified up-classified document absent further court authorization. The court emphasized that the government had already searched the materials multiple times and had not identified additional classified information.

As of January 2026, the case remained pending for purposes of enforcement and certification of compliance with the court’s return-of-property order.

MINUTE ORDER: The Court is in receipt of the Government's 31 Motion for Order regarding its Supplement to Emergency Motion and Status Report. In its Motion, the Government informs the Court for the first time that, on December 15, 2025, it "lodged a complete copy of the covered materials (including classified information) that it had created" following the Court's December 12, 2025, Order with a Classified Information Security Officer ("CISO") in Washington, DC. Gov't's Mot., Dkt. No. 31 at 1, fn. 1 (internal citations omitted). In its December 12, 2025, Order, the Court ordered the Government to "return to Petitioner Richman all copies of the covered materials, except for the single copy that the Court [] allowed to be deposited, under seal, with the U.S. District Court for the Eastern District of Virginia." See Dkt. No. 20. The Court ordered the Government to certify compliance with its Order by 4:00 p.m. ET on December 15, 2025. Id. The Court further ordered that, until the Government certified compliance with its December 12 Order, the Government was "not to... share, disseminate, or disclose the covered materials to any person, without first seeking and obtaining leave of this Court." On December 15 (the Government's original deadline to certify compliance with the Court's December 12 Order), the Government requested a seven-day extension of its deadline to certify compliance with the Court's December 12 Order. Dkt. No. 22. Petitioner Richman consented to this extension. Id. And the Government represented that it would "continue to comply with its obligation... not to access or share the covered materials without leave of the Court." Id. at 11 (citing Order, Dkt. No. 10 and Order, Dkt. No. 20). So the Court granted the Government's request for extension, thereby continuing the Government's deadline to certify compliance with the Court's December 12 Order to 4:00 p.m. ET on December 22. Order, Dkt. No. 26. As of this date, the Government has not certified compliance with the Court's December 12 Order. Accordingly, the Government is still under a Court order that prohibits it from accessing Petitioner Richman's covered materials or sharing, disseminating, or disclosing Petitioner Richman's covered materials to any person without first seeking and obtaining leave of this Court. See Dkt. No. 10; Dkt. No. 20; Dkt. No. 22; Dkt. No. 26. As the Government admits, the Government provided this copy of Petitioner Richman's materials to the CISO "after the Government filed its emergency motion," Gov't's Mot., Dkt. No. 31 at 1, fn. 1, in which the Government represented that it would "continue to comply with its obligation... not to access or share the covered materials without leave of the Court." Dkt. No. 22 at 11. Three days after the Government "lodged a complete copy" of Petitioner Richman's materials with a CISO in DC, the Government moves the Court to order "that a complete copy of the covered materials can be lodged with the Department of Justice's Litigation Security Group." Dkt. No. 31 at 1. The Government does not explain this position any further, but it appears to be arguing that the copy of Petitioner Richman's materials that the Court initially permitted the Government to deposit with the District Court in the Eastern District of Virginia should instead be deposited with the Department of Justice's Litigation Security Group. The Court would benefit from more briefing from the parties given the uncertainty surrounding the Government's request to deposit Petitioner Richman's materials with the DOJ's Litigation Security Group instead of the District Court in the Eastern District of Virginia. Accordingly, the Court hereby ORDERS that Petitioner Richman shall file a response to Defendant's 31 Motion on or before 5:00 p.m. ET on Monday, December 22, 2025. This response shall address the Government's argument that the Court should permit the Government to deposit a copy of Petitioner Richman's materials with the Department of Justice's Litigation Security Group instead of the District Court in the Eastern District of Virginia. It is further ORDERED that, pursuant to the Court's December 12 Order, the Government shall not access Petitioner Richmans covered materials or share, disseminate, or disclose those covered materials to any person without first seeking and obtaining leave of the Court.
