On December 5, 2025, Dallas County, Texas brought this suit against the US Department of Health and Human Services as well as Secretary Robert F. Kennedy, Jr., in his official capacity. Plaintiffs sought to challenge HHS' termination of “COVID-related” CDC grant programs en masse. Filing under the Separation of Powers and Spending Clause, the APA, and equitable ultra vires, Plaintiff requested a vacatur of the mass-termination decision and injunction to reinstate unlawfully terminated grants.
