This is a case challenging the City of Leesville's denial of Plaintiffs' application to have their property annexed into the municipality, a decision they alleged was driven by improper motives and impaired their ability to participate in the local political process.

Plaintiffs, a married same-sex couple, owned property that was surrounded on three sides by the Leesville city limits. They sought annexation in order to participate in the local political process, reduce utility expenses, and contribute to the tax base of their immediate community. Plaintiffs alleged they made three attempts to have their property annexed, including a third attempt through an individual application. Plaintiffs further claimed that the city failed to follow required procedures and denied the application even though Plaintiffs allegedly met all requirements for annexation.

On September 25, 2025, Plaintiffs brought this lawsuit in the 30th Judicial District Court of Louisiana against the City of Leesville, the Leesville City Council, and several city officials. Plaintiffs sued under 42 U.S.C. §§ 1983 and 1985, the Voting Rights Act of 1965, the First, Fourth, and Fourteenth Amendments of the United States Constitution, as well as state laws and city ordinances. They sought injunctive relief and a devolutive appeal. Represented by private counsel, Plaintiffs claimed that city officials repeatedly failed to follow statutorily and constitutionally required annexation procedures, arbitrarily denied annexation without a meaningful opportunity to be heard, and treated Plaintiffs differently from similarly situated property owners. They further alleged that the denial was driven by discriminatory motives based on their status as married men and by political considerations related to the potential mayoral candidacy of one of the Plaintiffs.

On October 8, 2025, the case was removed to the U.S. District Court for the Western District of Louisiana and assigned to District Judge James D. Cain, Jr. In a January 20, 2026 Memorandum Order, the court denied Plaintiffs' motion for a preliminary injunction and declined to grant relief before the February 13, 2026, mayoral qualification deadline, citing their inability to show a substantial likelihood of success on their constitutional and statutory claims and their two-month delay in filing the motion. The court deferred the remaining motions for a permanent injunction and judicial review for resolution after a full hearing. 2026 WL 161776.
