This is one of dozens of lawsuits in which the U.S. Department of Justice seeks voter data from the states.   Here are all the DOJ Voter Data lawsuits in the Clearinghouse collection.  On December 2, 2025, the Attorney General of the United States filed suit against the Secretary of State of Rhode Island in the U.S. District Court for the District of Rhode Island.  The complaint alleged that the United States was investigating Rhode Island's compliance with two federal election laws, the Nation…

This is one of dozens of lawsuits in which the U.S. Department of Justice seeks voter data from the states.   Here are all the DOJ Voter Data lawsuits in the Clearinghouse collection. 

On December 2, 2025, the Attorney General of the United States filed suit against the Secretary of State of Rhode Island in the U.S. District Court for the District of Rhode Island.  The complaint alleged that the United States was investigating Rhode Island's compliance with two federal election laws, the National Voter Registration Act (“NVRA”) and Title III of the Help America Vote Act (“HAVA”), which require the state to retain voter registration lists and certain other voter records.  On September 8, 2025, the United States sent a letter to Rhode Island requesting that the state provide a current electronic copy of its computerized statewide voter registration list, including each registrant’s full name, date of birth, residential address, and state driver’s license number or last for digits of social security number.  On September 16, Rhode Island's Secretary of State sent a letter refusing to provide the requested information. The United States asserted that this refusal violated the Civil Rights Act of 1960, which requires state election officials to retain and preserve certain voting records. It sought declaratory relief and an order requiring the Secretary to provide the requested records. Also on December 2, the United States filed a motion seeking production of documents, namely the requested voter data.  The case was assigned to Judge Mary S. McElroy. 

On December 9, 2025, in two separate motions, Common Cause, a non-partisan, good-government organization dedicated to grassroots voter engagement in Rhode Island, SEIU District 1199NE and the Rhode Island Alliance for Retired Americans, both membership-based organizations, and five individual Rhode Island voters moved to intervene as defendants in the lawsuit. The court granted the unopposed motions to intervene on January 6, 2026.  The Secretary of State and intervenor defendants filed separate motions to dismiss the lawsuit on January 13, 2026. 

This case is ongoing.
