This lawsuit challenges the unanticipated halting of the Sunrise Wind Farm and Sunrise Wind Export Cable offshore wind project off the coast of New York by the federal government.

The Sunrise Wind Farm and Sunrise Wind Export Cable project was approved in 2024 after the federal government engaged in a multi-year and multi-agency review of the project. The Project was set to build wind turbines on the Outer Continental Shelf and provide energy to New York State. In July 2024, after securing all necessary permits and approvals from the federal government, Sunrise Wind began construction.

On December 22, 2025, after billions of dollars had been spent and the Project was about 45% complete, the Bureau of Ocean Management (“BOEM”), which is located within the U.S. Department of the Interior, abruptly issued an order suspending construction of the Project (the “Stop Work Order”) because of “impacts to national security from offshore wind projects.” The Stop Work Order came without warning or hearing.

Sunrise Wind LLC brought suit against the Department of the Interior, BOEM, and the Bureau of Safety and Environmental Enforcement on January 6, 2026, in the U.S. District Court for the District of Columbia. In the complaint, Sunrise Wind alleged that the Stop Work Order violated the Outer Continental Shelf Lands Act, the Administrative Procedure Act (APA), and the Procedural Due Process Guarantees of the Fifth Amendment. In relief, Sunrise Wind sought declaratory and injunctive relief to allow the Project to continue, as well as attorneys’ fees. The case was assigned to Judge Royce C. Lamberth.

On January 9, 2026, Sunrise Wind filed a motion for a preliminary injunction and a stay of the Stop Work Order pending review. They also filed a notice of supplemental authority on January 20, informing the court of several new U.S. district court decisions preliminarily enjoining Defendant BOEM’s December 22, 2025 orders to other offshore wind projects—which are nearly identical to the Stop Work Order Sunrise Wind challenges in this case.

After briefing and a hearing, the court granted the preliminary injunction for reasons stated on the record at the hearing on February 2, 2026. 

This case is ongoing.
