On January 9, 2026, Plaintiffs filed this lawsuit against the Department of the Interior, the Bureau of Ocean Energy Management, and their respective leadership in U.S. District Court for the District of Columbia. Plaintiffs - New York State and New York Energy Research and Development Authority - sought to vacate a December 22, 2025 stop work order effectively suspending all offshore wind construction projects on the Outer Continental Shelf, around 14 miles southeast of Long Island. Alleging arbitrary and capricious action under the Administrative Procedure Act, Plaintiffs sought declaratory judgment, a vacatur of the stop work order, and preliminary and permanent injunction barring its enforcement.
