In response to reports of illegal conduct, New York's Office of the Attorney General (OAG) brought suit against President Trump in 2022. After discovery, the court granted OAG partial summary judgment and held that President Trump and his co-defendants had committed fraud. Several federal courts rejected subsequent attempts by Trump to, as a private citizen at that time, undermine the legitimacy of the investigation. Following this suit, and another case brought by OAG against the National Rifles Association (NRA), Trump began to call for Attorney General Letitia James to be prosecuted.  In the wake of the court’s final judgment against him in February 2024, President Trump reposted comments by U.S. Representative Marjorie Taylor Greene that Attorney General James and Justice Engoron “belong in jail for the abuse of power they are wielding against President Trump and his family.”  In April 2025, President Trump renewed his calls for Attorney General James’s resignation:

“Letitia James, a totally corrupt politician, should resign from her position as New York State Attorney General, IMMEDIATELY. Everyone is trying to MAKE NEW YORK GREAT AGAIN, and it can never be done with this wacky crook in office.”

Subsequently, on August 5, 2025 OAG was served with two grand jury subpoenas authorized by the Acting U.S. Attorney John Sarcone III. Anonymous sources reported to the media that the subpoenas were part of a grand jury investigation into OAG’s and Attorney General James’s alleged violations of 18 U.S.C. § 242, which makes it a crime for government officials to willfully violate the legal rights of others. The Trump Administration reportedly claimed that OAG and Attorney General James violated Mr. Trump’s First Amendment rights when OAG sued him, when a private businessman, on behalf of the People of the State of New York. Both subpoenas call for production, dating back to 2022 (New York v. Trump) and 2020 (New York v. NRA), of “[a]ny and all documents and records relating to the Subject Case” or “reflecting communications about the Subject Case between any agent and/or employee of the Office of the New York State Attorney General and any other third-party individual and/or entity."

In response, on August 19, 2025, the New York OAG--in conjunction with attorneys from Munger, Tolles & Olson, and Capezza Hill--filed a motion to quash the subpoenas in the United States District Court for the Northern District of New York. The case was assigned to Senior District Judge Sidney H. Stein. The case was then reassigned to Senior Judge Lorna G. Schofield of the Southern District. OAG alleged that the subpoenas were issued in retaliation and with an intent to harass Attorney General James. 

On January 9, 2026, Judge Schofield dismissed the subpoena, without reaching the merits of the retaliation claims, finding that the Mr. Sarcone was not lawfully serving as Acting U.S. Attorney when the subpoenas were issued. 2026 WL 60793. Under the Federal Vacancies Reform Act (FVRA), when a vacancy arises, federal law provides limited alternatives to fill the position temporarily. The U.S. Attorney General initially appointed Mr. Sarcone as Interim U.S. Attorney for 120 days. When that term expired, the district judges declined to use their statutory authority to extend his tenure. The FVRA then required the use of other statutory procedures to fill the position. However, on the same day that the judges declined to extend Mr. Sarcone’s appointment, the Department of Justice took coordinated steps -- through personnel moves and shifting titles -- to install Mr. Sarcone as Acting U.S. Attorney. Numerous courts across the country rejected similar workarounds to the FVRA. See United States v. Giraud, 795 F. Supp. 3d 560, 606 (D.N.J. 2025), aff’d, 160 F.4th 390 (3d Cir. 2025);  United States v. Garcia, No. 25 Cr. 230, 2025 WL 2784640, at *18 (D. Nev. Sept. 30, 2025), appeal docketed, No. 25-6468 (9th Cir. Oct. 14, 2025); United States v. Ramirez, No. 25 Cr. 264, 2025 WL 3019248, at *20 (C.D. Cal. Oct. 28, 2025). According, the court disqualified Mr. Sarcone from any further involvement in prosecuting or supervising any investigation related to the subpoenas.

Trump, Index No. 452564/2022 (Sup. Ct. N.Y. Cnty.), and New York v. National Rifle Association, Index No. 451625/2020 (Sup. Ct. N.Y. Cnty.). Should the Federal Government re-issue the subpoenas at the direction of a lawfully authorized attorney for the Federal Government, without Mr. Sarcone's involvement, the State Government may renew its motion to quash.
