United States Senator Mark Kelly filed this lawsuit on January 12, 2026, in the U.S. District Court for the District of Columbia, challenging retaliatory actions taken against him by military officials. The complaint alleges that Kelly had been publicly criticizing various Trump Administration military actions since June 2025, including deploying troops and the National Guard, and in November 2025, he joined five other Congress members in releasing a video reminding servicemembers of their longstanding and widely accepted legal obligation to refuse unlawful orders. President Trump and Defense Secretary Pete Hegseth publicly branded Kelly's statements as "sedition" and "treason," leading Secretary Hegseth to issue a "Secretarial Letter of Censure" against Kelly on January 5, 2026, and initiate proceedings to reduce his military retirement grade and pay. Kelly brought seven counts against the defendants, including violations of the First Amendment, Speech or Debate Clause, separation of powers, due process, federal military law, and the Administrative Procedure Act. He seeks declaratory and injunctive relief to halt the enforcement of these retaliatory actions.

The same day, Senator Kelly filed a motion for a temporary restraining order, a preliminary injunction, and a stay under 5 U.S.C. § 705 seeking to halt "the effect of the Secretarial Letter of Censure, the reopening of his retirement grade, and any other proceedings predicated on these actions." Senator Kelly reported that these proceedings would inflict immediate and irreparable harm as these actions "impose official punishment for protected speech, chill the exercise of legislative oversight, and threaten reductions in rank and pay." Senator Kelly requested the court grant relief by January 16, 2026, as the letter of censure demanded a response within 10 days and stated that a lack of response would serve as a waiver of rights.

The case was then assigned to District Judge Richard J. Leon.

On January 14, 2026, the parties submitted a joint scheduling motion reporting that defendants had agreed to give Senator Kelly until February 4 to respond to the letter of censure and to wait to formalize any decisions contained with the letter until the court had ruled on the preliminary injunction and stay. The court granted the motion.

After a hearing on February 3, 2026, the court granted the preliminary injunction in part on February 12, 2026, enjoining defendants from implementing, enforcing, or otherwise giving effect to the Secretarial Letter of Censure. On the First Amendment retaliation claim, the court determined, contrary to defendant's assertions, that Kelly's speech was protected because no precedent extends Parker v. Levy's limits on active-duty servicemembers' First Amendment protections to retired servicemembers, especially those serving in Congress. The court also found that the censure and retirement grade proceedings constituted retaliatory action sufficient to deter ordinary persons, with a clear causal link between the protected speech and adverse action. Judge Leon concluded his opinion with suggesting that Secretary Hegseth and his fellow Defendants should "reflect and be grateful for the wisdom and expertise that retired servicemembers have brought to public discussions and debate on military matters in our Nation over the past 250 years," rather than try to shrink their First Amendment rights.
