Petitioner-Plaintiff M-J-M-A- and Plaintiff Victor Cruz Gamez brought this challenge on behalf of themselves and similarly situated individuals. They seek to represent a class of individuals in Oregon who have been arrested or will be arrested for alleged immigration violations without a warrant and without a pre-arrest, individualized assessment of probable cause that the person is in the United States in violation of civil immigration laws and that the person poses a flight risk. The plaintiffs allege that Immigrations and Customs Enforcement (ICE) agents are engaged in a policy of "making warrantless arrests without probable cause" in Oregon and that practice is unlawful.

MINUTES of Proceedings: Discovery Hearing held by videoconference before Judge Mustafa T. Kasubhai on January 22, 2026. Petitioner demands nine categories of documents responsive to her Requests for Production as outlined in her informal brief emailed to the Court on January 16, 2026. Respondents object and argue that the documents sought are not relevant or are disproportionate to the needs of the case. The Court hereby ORDERS that Respondents shall produce all documents identified by Petitioner in Items #17 and #9 within 30 days, subject to the following exceptions: With regard to #4(a)(e), (i), and (j), production shall be limited to documents that describe the assignment, its scope, and any instructions to ICE agents or other federal officers involved with regard to their assignment and mission objectives in Portland, Oregon that resulted in Petitioner's arrest. Documents in #4 are relevant and shall be produced but only to the extent they were communicated to or by officers involved in this case. With regard to #5, documents are relevant and shall be produced but only to the extent the documents were communicated by members of Arrest Team 7. With regard to Requests #5 and #9, the 7-day period is reduced to include only October 29-31, 2025. With regard to #6, Respondents represent that they may not be able to produce those emails within 30 days; if they are unable to do so, Respondents shall provide a status report to Petitioner and the Court describing in detail their difficulties in producing those documents.
