The petitioner, Any Lucia Lopez Belloza, is a citizen of Honduras who was brought to the United States when she was eight years old. Her mother reported to immigration authorities, and they were both released into the United States to await adjudication of their status, settling in Texas. In March 2016, her mother's application for asylum and withholding of removal was denied, and a removal order was entered against the petitioner and her mother in early 2017. At the time of her removal, Petitioner was a student at Babson College. On November 20, 2025, Petitioner was arrested by two Immigration and Customs Enforcement (ICE) officers at Logan Airport in Boston. She was held at an ICE field office in Massachusetts and then transferred to Hanscom Air Force Base. On November 21, she was placed on an ICE-chartered flight to a detention center in Port Isabel, Texas, arriving late that afternoon.

At 6:00 p.m. on November 21—roughly an hour after she arrived in Texas—her attorney filed a habeas corpus petition under 28 U.S.C. § 2241 in the U.S. District Court for the District of Massachusetts. The lawsuit named several federal officials as respondents, including the ICE Field Office Director and the Secretary of Homeland Security. Ten minutes later, an emergency judge issued a temporary stay order barring ICE from transporting Petitioner out of Massachusetts or outside the territorial jurisdiction of the United States for 72 hours. 2025 WL 3298018. However, an ICE duty officer incorrectly assumed the order did not apply because Petitioner was already in Texas, and he failed to flag her file. In contravention of the judge's order, ICE placed Petitioner on a flight the next morning, November 22, and removed her to Honduras.

The case was subsequently assigned to Judge Richard G. Stearns. In December 2025, Petitioner (through counsel) filed a motion for an order to show cause and for sanctions against the government. Following a hearing where the government admitted its mistake, Judge Stearns issued an order on January 16, 2026. 2026 WL 125168. The court determined it lacked jurisdiction over the petitioner's underlying habeas claims because the petition was filed in Massachusetts after she was already confined in Texas. However, the court ruled it retained inherent authority to address the violation of its emergency stay order. Judge Stearns initially recommended that the Secretary of State grant the petitioner a student visa to return.

After the Secretary of State declined the court's invitation to issue a visa, Judge Stearns issued an Order on Civil Contempt on February 13, 2026. 2026 WL 407953. Rejecting the government's argument that returning the petitioner would be futile, the court ordered the respondents to facilitate the petitioner's return to the United States within fourteen days to restore the status quo that existed before the wrongful removal.

On February 26, the government filed a motion to dismiss the habeas proceeding and submitted status reports indicating they had arranged for the petitioner's return flight to the United States. However, the petitioner ultimately declined to board the flight, fearing she would be removed again upon arrival in the United States. On March 6, Judge Stearns granted the government's motion to dismiss the case. The court reasoned that because the government complied with the facilitation order by arranging the flight, any civil contempt had dissolved. Because the petitioner declined the flight, the judge ruled that she waived the court's only remaining basis for jurisdiction, necessitating the dismissal of the petition.

On March 6, 2026, the petitioner filed a notice of appeal to the U.S. Court of Appeals for the First Circuit.

The appeal remains ongoing.

Judge Richard G. Stearns: ELECTRONIC ORDER entered. Petitioner Any Lucia Lopez Belloza attends college in Massachusetts, and prior to enrolling in school here was a resident of Texas. In an affidavit of ICE Assistant Field Director Keith Chan, the government represents that on November 20, 2025, U.S. Customs and Border Protection (CBP) officers, encountered Petitioner at Boston Logan International Airport, took her into custody, and transferred her to the ERO Boston Field Office for processing. Chan Decl. (Dkt #8-1) para. 8. On November 21, 2025, Petitioner was transferred by ICE from Massachusetts to Texas via a flight that departed at 12:27 PM. Id. para. 9. Petitioner arrived in Texas at 4:48 PM on November 21, 2025. Id. At 6:10 PM on November 21, 2025, the federal District Court in Massachusetts issued an Order that "respondents will not remove the petitioner from the jurisdiction of the United States or transfer petitioner to a judicial district outside that of Massachusetts for a period of at least at least 72 hours from the time this Order is docketed." Dkt #2. Petitioner was housed at the Port Isabel detention facility, and on November 22, 2025, ICE put her on a flight that left the United States from Harlingen, Texas at 10:35 AM and landed in Honduras at 1:09 PM. Chan Decl. para. 10. The court will provide petitioner's counsel an opportunity to file a Reply to defendants' Response (Dkt #8) to the petition for Writ of Habeas Corpus (Dkt #1).
