This putative class action lawsuit challenges the conditions at the Adelanto ICE Processing Center, including denial of basic necessities like medical and mental health care, access to the outdoors, adequate nutrition and water, and sanitary living conditions.
On January 26, 2026, four individuals detained at Adelanto and the Coalition for Humane Immigrant Rights, a nonprofit immigrant advocacy organization, filed this lawsuit in the U.S. District Court for the Central District of California against U.S. Immigration and Customs Enforcement (ICE), its Acting Director and the Acting Director of the Los Angeles field office and the U.S. Department of Homeland Security (DHS) and its Secretary, Kristi Noem. The individual plaintiffs sought to represent a class of all people who are now, or who in the future will be, detained at Adelanto, as well as a subclass of all people who have disabilities within the meaning of the Rehabilitation Act and are now, or in the future will be, detained at Adelanto. They asserted that the conditions at Adelanto, including the failure to provide sufficient food, clean drinking water, adequate sanitation, and medical care, as well as restrictive and unnecessary limitations on access to the outdoors and to loved ones as well as retaliation, amounted to punishment in violation of the Due Process Clause of the Fifth Amendment. Plaintiffs also asserted a Fifth Amendment Due Process claim grounded in allegedly inadequate medical care, including failure to respond to urgent and emergent medical and mental health needs, to address disease outbreaks, to ensure continuity of care and medication, and insufficient medical staffing. The of the individual plaintiffs also brought a claim for disability discrimination in violation of Section 504 of the Rehabilitation Act, citing the defendants' failure to ensure reasonable accommodations, including providing them with assistance for mobility needs, auxiliary aids and services, and effective communication. Plaintiffs also brought a claim for arbitrary and capricious and unlawful agency action in violation of the Administrative Procedure Act, in light of the defendants' alleged failure to follow their own policies and standards governing detention, including by rapidly increasing the number of people detained at Adelanto despite obvious risks and performing an inadequate inspection of the facility. Plaintiffs sought certification of the class, declaratory relief, preliminary and permanent injunctive relief, including enjoining defendants from retaliating, attorneys' fees, and costs. The case was assigned to District Judge Fernando M. Olguin.
