Under the first Trump Administration, a federal court concluded the Administration’s decision to terminate Temporary Protected Status (“TPS”) for Haitians nationals was unlawful and enjoined it. Despite this outcome, the Trump Administration once again terminated TPS for Haitians. This lawsuit challenges the Trump Administration’s renewed decision to remove TPS from Haitians present in the United States. 

The Temporary Protected Status statute allows for the Department of Homeland Security (“DHS”) to designate a country for TPS if its citizens are unable to return to their home country due to armed conflicts, environmental disasters, or other extraordinary and temporary conditions. Once a country is designated for TPS, eligible citizens of that country who are present in the US receive deportation protections and work authorization until the country’s TPS designation is lawfully terminated. Congress, through the TPS statute estab;lished a mandatory process for the Secretary of Homeland Security to follow to determine where a country’s TPS designation should be extended, redesignated, or terminated. 

On June 27, 2025, Secretary of Homeland Security Kristi Noem announced that Haiti’s TPS designation would be terminated because “[g]ang violence in Haiti persists as armed groups operate with impunity, enabled by a weak or effectively absent central government.” She reasoned that TPS incentivizes unlawful migration from Haiti to the US, and some percentage of Haitian TPS holders who came to the US because of the incentive are necessarily violent criminals who must be kept out of the US.

The Plaintiffs, individual Haitians who hold TPS, brought suit on July 30, 2025 in the U.S. District Court for the District of Columbia against President Trump, DHS, and Secretary Noem. They alleged that the removal of Haitians’ TPS status was unlawful and pretextual, as President Trump had already announced that he would terminate Haiti’s TPS while complaining in 2024 because they were “stealing and eating the house pets of American citizens.” The Plaintiffs also sought to represent a class of similarly situated Haitian TPS holders who, without TPS status, would lose their ability to legally work in the US, and if forced to return to Haiti, would face imminent danger and possible death from gang violence, lack of medical care, or starvation.

In their complaint, the Plaintiffs alleged two counts. First, they alleged that the Trump Administration’s decision to end Haiti’s TPS designation violated the Administrative Procedure Act (“APA”) because it was arbitrary and capricious and not in accordance with the law. Second, they argued that the termination violated the Fifth Amendment guarantee of Equal Protection because the termination was at least in part improperly motivated by animus and discriminatory intent based on race, national origin, and ethnicity. The Plaintiffs sought class certification, an order setting aside the termination of Haiti’s TPS designation, and attorneys’ fees. The case was assigned to Judge Ana C. Reyes.

On August 20, 2025, the Plaintiffs filed a motion to stay the DHS’s decision to terminate the Haitian TPS status. The AFL-CIO, 15 states, and members of Congress filed amicus briefs supporting Plaintiffs’ motion to stay.

The court issued a minute order on September 22, 2025, denying without prejudice the Plaintiffs’ motion to stay in light of the parties’ agreement in a different case that “Secretary Noem's partial vacatur has been set aside," the government’s website indicating that Haiti's current TPS designation lasts through February 3, 2026, and the government's representation in a Joint Status Report that the Secretary will publish notice of new agency action regarding Haiti’s TPS status by December 5, 2025. 

On September 26, 2025, the Plaintiffs filed a motion for reconsideration of the order denying a stay. After a hearing, the court denied the motion on September 29, but ordered the Defendants to inform the court “whether Haiti's TPS designation will remain in effect through February 3, 2026, for all putative class members” and to compile the relevant administrative record.

The Plaintiffs filed a motion for class certification on October 28, 2025, seeking to certify a class of persons in the United States who have been granted or applied for TPS with Haiti as the designated TPS country. They maintained that a class action was not required to secure vacatur under the APA but they did so “out of an abundance of caution given the arguments that the government has made in other, similar cases.” 

On December 1, 2025, the court held a hearing in light of the release of the unpublished version of the Secretary's Notice regarding the termination of Haiti's TPS status. The court directed the Plaintiffs to file an amended complaint, and the Defendants to file their administrative record. The Defendants filed the administrative record on December 10, and the Plaintiffs filed the first amended complaint on December 5. The amended complaint added factual allegations that on November 28, 2025, Secretary Noem issued a new termination notice ending “Haiti’s TPS designation based on her subjective belief that Haitians have had TPS for too long” and because it was “contrary to the national interest of the United States to permit Haitian nationals … to remain temporarily in the United States.”

The Defendants filed a motion to dismiss the amended complaint, and the Plaintiffs filed a renewed motion to stay the termination of Haitian TPS status on December 12, 2025. 

On December 19, the Plaintiffs filed a second amended complaint, which added factual allegations regarding systematic termination of TPS designations for 15 predominantly non-white countries by the Trump Administration and argued this pattern shows “predetermined agenda rather than a good-faith, fact-based, country-specific review.” The new complaint also added new allegations of procedural violations involving inadequate inter-agency consultation, and additional evidence of racial animus through Trump’s public statements.

After a hearing on the motions to dismiss and stay, the court granted the Plaintiff’s renewed motion for a stay and denied the Defendant’s motion to dismiss on February 2, 2026. 2026 WL 266413. The court found that it did have jurisdiction, and that it was “substantially likely” that “Secretary Noem preordained her termination decision and did so because of hostility to nonwhite immigrants.” However, the Secretary lacked the authority to make a baseless decision because “Congress passed the TPS statute to standardize the then ad hoc temporary protection system” and bound the discretion of the Secretary. Further, the court found that the Plaintiffs had made out a plausible Equal Protection claim because of the recorded animus towards non-predominately white countries and individuals by the Trump Administration. The court stayed consideration of the motion to certify the class on February 3.

On February 5, 2026, the Defendants filed a notice of appeal to the U.S. Court of Appeals for the District of Columbia of the court’s February 2 order granting the Plaintiffs’ stay and denying the Defendants' motion to dismiss. The Defendants also filed a motion to stay the district court’s order granting relief at the district court level, arguing that the TPS statute bars review of all claims, and that the court’s relief was overbroad in light of Trump v. CASA

The Defendants filed a similar motion to stay the underlying order pending appeal at the DC Circuit on February 6, 2026. Several parties have been granted leave to file amicus briefs in the appeal.

After briefing and a hearing, the district court denied the Defendants’ motion to stay the court's order on February 23, 2026. 2026 WL 493946. The court relied on substantially the same reasoning as the February 2 order, and also found there was no risk of irreparable harm to the Government in maintaining the status quo of Haiti’s TPS status.

After briefing, the Court of Appeals also denied defendants' request to stay the district court's proceedings on March 6. The court found that the government failed to demonstrate irreparable harm, offering only "generalized assertions of injury" rather than showing "certain," "great," and "imminent" irreparable harm. The court distinguished this case from similar TPS cases, noting there were no ongoing diplomatic negotiations with Haiti unlike in the Venezuela case, and the government had previously treated similar delays as tolerable. In contrast, the plaintiffs faced substantial documented harms, including risk of deportation, family separation, and violence in Haiti, and the government declined to represent that it would facilitate their return if they ultimately prevailed. Judge Walker of the U.S. Court of Appeals for the District of Columbia dissented, arguing the stay should be granted because the government was likely to succeed on the merits due to the TPS statute's no-review provision, the government suffered irreparable harm from improper judicial intrusion, TPS is meant to be temporary, and the Supreme Court's TPS stay orders should guide the court's decision.

Defendants then turned to the Supreme Court and filed a petition seeking to stay the district court's order postponing the agency action on March 10, 2026. The Plaintiffs also filed a conditional petition for a writ of certiorari with the Supreme Court on March 10. Plaintiff requested that the court deny cert in Doe v. Noem, a case challenging the Department of Homeland Security's (DHS) decision to terminate TPS for nine countries, or grant cert in this case if it is granted in Doe. Plaintiffs argue that although both cases involved termination of TPS status, the cases have distinct facts and should be heard through the normal course of litigation. Plaintiffs further argued that this case is a better vehicle to review the questions presented, as they present questions and facts not at play in Doe. Plaintiffs contended that "granting both petitions and consolidating them for argument is the only way for the Court to address immediately all the issues implicated by the Secretary’s various TPS designations."

In ruling on the government's petition, Justice Sotomayor and Chief Justice both deferred the application as a stay and instead considered it as a writ of certiorari. On March 16, the court granted certiorari and consolidated the case for arguments with Doe.

On March 13, the parties filed a joint status report in the district court informing them of their pending matters before the Supreme Court. The parties agreed to confer and decide how best to proceed in the district court litigation after the Supreme Court ruled on the pending petitions.

July 28, 2025), Dkt. 70 at 5; (2) the government's website indicating that Haiti's current TPS designation lasts through February 3, 2026 (https://www.uscis.gov/humanitarian/temporary-protected-status/temporary-protected-status-designated-country-haiti); and (3) the government's representation in 60 Joint Status Report that the Secretary will publish notice of new agency action regarding Haiti's TPS status by December 5, 2025, the Court DENIES these Motions without prejudice. Should Defendants reinstate the Secretary's partial vacatur in the interim, this Court is prepared to adjudicate a renewed Motion to Stay on an expedited basis and stay the partial vacatur in the interim if appropriate.
