On March 16, 2023, the United States filed federal charges against an individual defendant in the U.S. District Court for the District of New Jersey for allegedly accepting bribes in return for recommending and/or purchasing select medical equipment. 

Following the decision disqualifying then-acting U.S. Attorney Alina Habba or her supervisees from participating in any active prosecutions in the District, in United States v. Giraud, the defendant moved to disqualify Habba and those she supervised from further participation in his prosecution. Then-presiding judge Michael E. Farbiarz transferred the case to Chief Judge Matthew W. Brann of the United States District Court for the Middle District of Pennsylvania, sitting by designation, who, in turn, stayed this case pending resolution of the appeal in Giraud. On October 22, 2025, while awaiting sentencing, the defendant filed a motion to dismiss the indictment, asserting that the ongoing stay while awaiting resolution of a "frivolous appeal" violated his due process rights.  This lawsuit was combined with United States v. Torres, 2:24-CR-0378 (D.N.J.), for purposes of deciding the motion to dismiss. Thereafter, on December 1, 2025, the U.S. Court of Appeals for the Third Circuit affirmed the disqualification and, on December 8, Habba resigned.  That same day, U.S. Attorney General Pamela Bondi appointed and delegated authority to three individuals to run the United States Attorney’s Office for the District of New Jersey, the so-called "triumverate".  On December 24, 2025, the defendant filed an omnibus motion to dismiss, asserting that dismissal of the indictment would serve as a check on the federal governments' abuse of the Fifth Amendment's liberty and due process interests and would rectify Appointments Clause violations.  

On March 9, 2026, the court granted in part the defendant's motion to dismiss.  It denied the motion with respect to dismissal, but granted it with respect to disqualifying the triumvirate from prosecuting the defendant or supervising the prosecution of his case.  In particular, the court disqualified the triumvirate from participating in the prosecution of the consolidated cases and from supervising any Assistant United States Attorney prosecuting these matters, reasoning that the current leadership structure for the Office exceeded the Attorney General’s statutory authority to appoint inferior officers and delegate them powers, and therefore was a unilateral appointment in violation of the Appointments Clause. The court warned the federal government that "any further attempts to unlawfully fill the office will result in dismissals of pending cases." 

This matter is ongoing.
