The American Federation of Labor and Congress of Industrial Organizations (AFL-CIO) filed this suit on June 10, 2026, in the U.S. District Court for the District of Columbia against the Acting Secretary of Labor and the Director of the Office of Labor-Management Standards. The complaint challenged a DOL final rule titled “Labor Organization Annual Financial Reports,” promulgated on June 1, 2026, and set to take effect July 1, 2026. The Rule expanded annual financial reporting requirements for labor organizations under Title II of the Labor-Management Reporting and Disclosure Act (LMRDA), implementing changes that DOL had originally proposed in an October 2020 notice of proposed rulemaking (NPRM) but expressly withdrew in March 2021 as “no longer necessary.” A subsequent July 2025 NPRM addressed only filing thresholds and made no mention of the withdrawn 2020 rulemaking or broader changes. Yet, the Final Rule adopted many of those earlier proposals. Notably, the Rule creates an entirely new form, the Form LM-2 Long Form Labor Organization Annual Report, that the complaint alleged would burden labor organizations with re-categorization and itemization requirements.

Plaintiff asserted several causes of action under the Administrative Procedure Act (APA), including that the rule was issued without proper notice and comment, contained substantive provisions that are arbitrary and capricious, and imposed an effective date that is itself arbitrary and capricious. Plaintiff sought a preliminary injunction postponing the rule’s effective date, a declaratory judgment that the challenged provisions are unlawful and void, vacatur of those provisions, and attorneys’ fees and costs. The case was assigned to District Judge James E. Boasberg.

On June 11, 2026, Plaintiff filed a motion for a preliminary injunction seeking to extend the Rule’s effective date, asserting that the current effective date was arbitrarily soon. Plaintiff argued that the new Rule would require each labor organization to “dramatically retool” accounting systems to conform to the new reporting requirements and manually recode payments it entered before the new software came online, all before the July 1, 2026 date. Plaintiff requested an extension until January 1, 2027 to comply. Oral argument on this motion was held on June 29, 2026. The following day, the court denied Plaintiff’s motion for preliminary injunction, holding that it had not demonstrated irreparable harm.

Plaintiff moved for summary judgment on July 27, 2026. Defendant filed a cross motion for summary judgment on August 27, 2026. As of September 2026, briefing was ongoing on both motions.
