On September 17, 2024, the City of Huntington Beach and nine California parents filed a lawsuit in the U.S. District Court for the Central District of California against Governor Gavin Newsom, Attorney General Robert Bonta, and State Superintendent of Public Instruction Tony Thurmond. The plaintiffs challenged Assembly Bill 1955 (AB 1955), alleging it unlawfully barred school employees from disclosing students’ gender identity or expression to parents without consent, including in cases involving gender dysphoria. They further claimed the law interfered with parents’ constitutional rights to make medical and educational decisions for their children, citing potential long-term harm from social transitioning. The complaint also highlighted a conflict between AB 1955 and a local ordinance requiring parental notification, while detailing instances where schools allegedly withheld critical information about children’s well-being. The lawsuit sought injunctive relief, a declaratory judgment, and attorneys’ fees, asserting violations of the Fourteenth Amendment and other federal rights.
