On August 25, 2026, Neighborhood House—a nonprofit serving Medicaid recipients—and a 67-year-old Ukrainian Humanitarian Parolee receiving Supplemental Security Income (SSI) and long-term care filed suit in the U.S. District Court for the Western District of Washington against the U.S. Department of Health and Human Services (HHS) and its Secretary. The plaintiffs alleged that HHS’s guidance interpreting H.R. 1 (enacted July 4, 2025) unlawfully excluded noncitizen SSI recipients—including refugees, asylees, and trafficking victims—from Medicaid eligibility unless they obtained lawful permanent resident status. They claimed the guidance violated federal law by terminating benefits for approximately 150 of Neighborhood House’s clients, including the individual plaintiff, who relies on Medicaid-funded care for chronic conditions. The complaint further asserted that HHS’s interpretation was arbitrary and capricious, disregarding statutory protections for SSI recipients and inflicting irreparable harm on vulnerable populations. Plaintiffs sought declaratory and injunctive relief, including vacatur of the guidance and a stay of its implementation.
