On December 9, 2025, three nonprofit organizations—including two affiliates of the American Civil Liberties Union (ACLU) and one independent civil liberties group—filed suit in the U.S. District Court for the Southern District of New York against the Department of Justice (including its Office of Legal Counsel), the Department of State, and the Department of Defense. The plaintiffs alleged that since September 2, 2025, the U.S. government had conducted 22 lethal military strikes on boats in international waters, killing 87 civilians based on unproven claims that the vessels carried drugs, actions they argued violated domestic and international law. They further contended that the Trump administration had justified the strikes under a secret Office of Legal Counsel (OLC) opinion and a July 2025 Presidential Directive, both of which purportedly immunized military personnel from prosecution and remained undisclosed to the public. After submitting Freedom of Information Act (FOIA) requests on October 15, 2025, seeking the OLC opinion, the directive, and related records, the plaintiffs alleged that the defendant agencies failed to release any responsive documents or issue timely determinations. The complaint sought judicial intervention to compel disclosure of the requested records, along with costs and attorneys’ fees.
