Case: American Federation of Government Employees, AFL-CIO v. United States Department of Agriculture

Case Summary

(This summary is temporary as we research the case.) On September 8, 2026, federal unions, local governments, and several nonprofits sued the U.S. Department of Agriculture and the Secretary of Agriculture in her official capacity in the U.S. District Court for the Northern District of California. The plaintiffs challenged USDA’s reorganization plan, first announced in July 2025. The plan closed regional offices and research facilities and ordered employees to relocate on short deadlines or lose their jobs. The plaintiffs alleged that the plan violated fiscal year 2026 appropriations provisions barring USDA from reorganizing or relocating staff without congressional approval, and that the agency didn't consider how the plan would impair the agency's statutory function.

ORDER. According to the parties, the prohibition-without-committee-approval language at issue in this case has been used by Congress for USDA appropriations legislation since 2014. What is the history of Congress and USDA's treatment of this language over the past 12 years? For example, has USDA regularly conducted prohibited activities without obtaining committee approval? Or has USDA refrained from engaging in those activities absent approval? The parties should file supplemental briefs by Monday, September 28, 2026 addressing this question.
