In January 2000, the U.S. Department of Justice [DOJ] and the Montgomery County Department of Police [MCPD] entered into a Memorandum of Agreement pursuant to 42 U.S.C. §14141. The agreement resolved a complaint filed by the Montgomery County chapter of the NAACP alleging that the MCPD engaged in the unconstitutional practice of racial profiling. The agreement set forth changes to be implemented by the MCPD which included:
• a prohibition against racial profiling in traffic stops
• documentation of various information (including race) for all traffic stops
• implementation of a new computer system to track all complaints and investigations
• publication of semi-annual reports that provided statistical and summary information on traffic stops and complaint investigations
• retention of a police practices consultant to oversee compliance with the MOA.
The MOA was to remain in effect for five years.
