On June 12, 1996, Donald D McFarlane, a Washington state inmate, filed a pro se §1983 Complaint against the Washington Department of Corrections [DOC] in the U.S. District Court for the Eastern District of Washington, challenging restrictions on prison regulations regarding inmate mail.
The case was referred to Magistrate Judge Lonny R. Suko. Defendants moved for summary judgment.
On October 20, 1997, the District Court (Judge Robert H. Whaley) adopted the Report and Recommendation of Magistrate Judge Suko and granted in part and denied in part defendants' motion for summary judgment. In its order, the Court permanently enjoined the defendants from prohibiting delivery of inmate's paid-for subscriptions. Plaintiff was awarded damages and costs to be set by the Court. Defendants appealed.
For reasons that are not apparent from the docket, defendants' appeal was dismissed by the Ninth Circuit on December 30, 1998.
