Plaintiff-homeowners brought suit in the U.S. District Court for the Southern District of Ohio under federal civil rights statutes, 42 U.S.C. §§ 1981 and 1982, and the Fair Housing Act (FHA), 42 U.S.C. §§ 3601-3619. Plaintiffs alleged that defendant-insurance company cancelled their policy because of the racial composition of the neighborhood.
On November 23, 1983, U.S. District Court Judge Walter H. Rice granted the defendant's motion for summary judgment as to one claim under the FHA and held that the Plaintiffs' FHA claims were subject to the statute of limitations, but denied summary judgment on the remaining FHA claim because there was a factual dispute about when the Plaintiffs were notified of the cancellation of their policy. Judge Rice also conditionally denied the Defendant's motion for summary judgment with respect to the Plaintiff's claims under the civil rights statutes, but required the Plaintiffs to file an amended Complaint alleging intentional discrimination. Pierce v. Metropolitan Property and Liability Ins. Co., 1983 U.S. Dist. LEXIS 11368 (S.D. Ohio Nov. 25, 1983).
On August 1, 1984, Judge Rice rejected Defendants' renewed motion to dismiss the FHA claim, holding that the FHA barred insurance redlining. Pierce v. Metropolitan Property and Liability Ins. Co., 1984 U.S.Dist. LEXIS 24653 (S.D. Ohio Aug. 1, 1984).
