Plaintiffs, a minority couple and a neighborhood association, filed suit in the U.S. District Court for the Northern District of Ohio on May 30, 1989, alleging violations of the Fair Housing Act (FHA), 42 U.S.C. 3601-3619, federal civil rights statutes, 42 U.S.C. 1981, 1982, and 1985(3), and the Civil Rights Act of 1966, 42 U.S.C. 2000d. The individual Plaintiffs had applied for a loan from the Defendant-lender to purchase a home in a racially mixed area. After the Defendant-lender's appraiser initially priced the house at the Plaintiffs' purchase price, the appraiser subsequently reduced the assessment, leading the Defendant-lender to deny the Plaintiffs' loan application. Another purchaser subsequently bought the house for the original appraisal value.

On August 24, 1992, U.S. District Court Judge Nicholas J. Walinski granted in part and denied in part the Defendant-lender's motion for summary judgment. Steptoe v. Savings of America, 800 F. Supp. 1542 (N.D. Ohio 1992). Judge Walinski dismissed the Plaintiffs' claim under 42 U.S.C. 1985(3), finding that the Defendant-lender could not conspire with itself to deprive the Plaintiffs of their civil rights. The court also granted the Defendant-lender's motion with respect to the Plaintiffs' claim under 42 U.S.C. 2000d, finding that the Defendant-lender had not obstructed Plaintiffs' access to federal funds. Judge Walinski denied, however, the Defendant-lender's motion for summary judgment with respect to the FHA, Section 1981, and Section 1982 claims.

On September 25, 1994, the Plaintiffs dismissed the case pursuant to a plea agreement.
