ORDER granting in part and denying in part Defendants' 52 Motion for Summary Judgment. Defendants' motion for summary judgment is GRANTED as to Plaintiff's claim for injunctive and declaratory relief and claims against Fulton County and Freeman in his official capacity. Defendants' motion for summary judgment is DENIED as to Plaintiff's claims for compensatory, nominal, and punitive damages against Freeman in his individual capacity as Fulton County Sheriff. Plaintiff's 50 Motion for Partial Summary Judgment is DENIED. This action will be scheduled for trial after the court receives the parties' pretrial order.
