On November 15, 2012, Legal Services for Prisoners with Children (LSPC) filed suit in Alameda County Superior Court under California state law against Alameda County and the Alameda County Sheriff. The plaintiffs, represented by the Disability Rights Advocates and the Disability Rights Legal Center, sought declaratory relief, an injunction, and attorney's fees, alleging that the County of Alameda systematically discriminated against men and women with disabilities housed at Santa Rita Jail. Specifically, the plaintiffs alleged that the County denied disabled inmates access to physically accessible cells, toilets, showers, and visiting areas. The plaintiffs also alleged that the County often involuntarily segregated persons with disabilities from the general population, resulting in the denial of access to rehabilitative programs, religious services, and outdoor exercise.
After entering into settlement talks, the parties filed a stipulation regarding the protective order on June 6, 2013. The court (Judge Steven Brick) granted the stipulation in part. The parties continued settlement talks, and as of August 23, 2013, the case appeared ongoing according to the docket.
