ORDER granting in part and denying in part 40 Motion for Summary Judgment by defendants Timothy Geithner and Douglas Schulman, now succeeded by Jacob Lew and Daniel Werfel. The motion is GRANTED with respect to plaintiffs' challenge to 26 U.S.C. § 107(1); plaintiffs' complaint is dismissed as to that claim for lack of standing. The motion is DENIED as to plaintiffs' challenge to 26 U.S.C. § 107(2). On the court's own motion, summary judgment is GRANTED to plaintiffs as to that claim. It is DECLARED that 26 U.S.C. § 107(2) violates the establishment clause of the First Amendment and defendants are ENJOINED from enforcing § 107(2).
