The plaintiff sued Montgomery County, its sheriff, and its jail administrator under 42 U.S.C. § 1983. The plaintiff, represented by private counsel, sought injunctive, declaratory, and monetary relief, claiming violations of the Eighth Amendment’s prohibition of cruel and unusual punishment and the Fourteenth Amendment’s Due Process Clause. The plaintiff alleged that the jail did not provide adequate food and nutrition, which caused him and other inmates to experience dramatic weight loss, hair loss, skin conditions, and other medical conditions, including scurvy.

The plaintiff sought to represent a class of inmates who, like himself, had been denied proper nutrition at the Montgomery County Jail. On September 29, 2017, District Judge Brenda K. Sannes denied the motion for class certification, without prejudice, ruling that the plaintiff failed to satisfy the typicality and adequacy requirements of Federal Rule of Civil Procedure 23(a).

On May 29, 2018, the court dismissed the plaintiff’s claims for injunctive and declaratory relief as moot because he had filed his complaint four months after he was released from the jail. He filed an amended complaint on August 9, 2018, and was joined by a second former inmate of the jail. The new plaintiff had been detained at the jail for several months both before and after conviction.

In the amended complaint, the plaintiffs sought again to represent a class. The court granted class certification on August 20, 2018, defining the class as all detainees, from July 24, 2011 onward, who had been detained at the jail for at least two consecutive weeks. The class was divided into two sub-classes: pre-trial detainees and post-trial detainees.

On November 7, 2019, the court denied the county’s motion for summary judgment. However, the court did strike the demand for declaratory and injunctive relief, as those claims had been dismissed on May 29, 2018, before the plaintiffs re-asserted them in the amended complaint. 2019 WL 5842822.

The parties set three different trial dates before agreeing to a settlement in late February. On July 8, 2020, the plaintiffs informed the court that they were ready to finalize the settlement agreement, except for one detail: the county was insisting that the plaintiffs’ attorneys agree not to publicly share information about the settlement, though the settlement would be a matter of public record. Two weeks later, the parties filed a settlement agreement with the court.

Under the settlement agreement, the defendant was required to set up a $1,000,000 settlement fund. An incentive award of $10,000 to each of the named plaintiffs and attorneys’ fees in the amount of $300,000 were designated to be paid from the settlement fund, with most of the remaining fund distributed on a pro rata basis. On June 2, 2021, the court granted final approval of the settlement agreement.

Based upon the submissions of the parties, and oral arguments on the record, the Court grants Plaintiff's motion to the following extent: (1) within 21 days of this order the Defendant shall provide to the Plaintiff's Counsel the name, address, telephone number, employer and other contact information, date of birth, social security number, date of arrest or confinement, and the date the detainee is released from the facility, for those detained at the Montgomery County Jail for at least two continuous weeks during the period from July 25, 2011 to the present; (2) the Defendant is not required to include the detainees height, weight and build in the information provided; (3) the Defendant will be in charge of hiring an appropriate computer expert to extract the information and to provide it to Plaintiffs Counsel in the most appropriate form; (4) the cost of the expense of producing the information shall be split equally between the Plaintiff and the Defendant, and (5) all of the data and information that is turned over shall be subject to a properly executed protective order that allows review of the records by the attorney and the parties liability and damages expert only. TEXT ORDER: On January 5, 2017, Plaintiff filed a Letter Request seeking an extension of time to file his Motion for Class Certification in this matter. Dkt. No. 69 . In that same Letter Request, Plaintiff advised that Nurse Hubschmitt has retained counsel and will appear for a deposition, however, since Plaintiff does not wish to delay the filing of such motion he suggested raising any relevant information obtained from her deposition in his Reply Brief. After reviewing the submissions from both counsel, Plaintiff's request for an extension of time to file his motion is GRANTED, however, such motion is to be filed after the deposition of Nurse Hubschmitt has been completed. The Court directs that Nurse Hubschmitt be deposed on or before February 9, 2017. Plaintiff shall file his Motion for Class Certification on or before February 23, 2017. TEXT ORDER: On the basis that they contain personal identifying information and information about sensitive medical conditions, Defendants move 83 to seal Exhibits B and J, and redact Exhibits A, E, F, and G, of their opposition to Plaintiffs motion for class certification 73 . As Defendants are submitting the exhibits in opposition to Plaintiffs motion for class certification, they would certainly be relevant to the judicial function and useful to the judicial process in probing behind pleadings to determine whether the plaintiffs suit meets the special criteria set for in Rule 23 for class certification. Tropical Sails Corp., v. Yext, Inc., No. 14-Civ. 7582, 2016 WL 1451548, * 3 (S.D.N.Y. 2016). They are therefore judicial documents. Second Circuit precedent "indicate[s] that... a strong presumption of access attaches [to judicial documents], under both the common law and the First Amendment." Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110, 121 (2d Cir. 2006). Further, the Court finds that the weight of the presumption of access to these documents is significant under both the common law and First Amendment analysis. Mark v. Gawker Media LLC, No. 13-CV-4347 (AJN), 2015 WL 7288641, at *2, 2015 U.S. Dist. LEXIS 154630, at *5 (S.D.N.Y. Nov. 16, 2015) (determining that the weight of the presumption of access to documents submitted in connection with motion for class certification to be significant.). Thus, the documents at issue should not remain under seal absent the most compelling reasons.'" Lugosch, 435 F.3d at 123 (quoting Joy v. North, 692 F.2d 880, 893 (2d Cir. 1982)). Moreover, under "the more stringent First Amendment framework... continued sealing of the documents may be justified only with specific, on-the-record findings that sealing is necessary to preserve higher values and only if the sealing order is narrowly tailored to achieve that aim." Id. at 124. Examples of "higher values" may include law enforcement interest, the privacy of innocent third parties, United States v. Amodeo, 71 F.3d 1044, 1050 (2d Cir. 1995), and the attorney-client privilege, Lugosch, 435 F.3d at 125. The party seeking to maintain the judicial documents under seal bears the burden of showing that higher values overcome the presumption of public access. DiRussa v. Dean Witter Reynolds Inc., 121 F.3d 818, 826 (2d Cir. 1997). Defendants seek to seal Exhibits B and J in their entirety and redact Exhibits A, E, F, and G, on the basis that they contain sensitive medical information and implicate the privacy interests of Plaintiff and several non-parties. (Dkt. No. 83-5, p. 6). Individual contact information and other personal identifying information may be redacted. See Mark v. Gawker Media LLC, No. 13-CV-4347 (AJN), 2015 WL 7288641, at *2 (S.D.N.Y. Nov. 16, 2015) (granting the parties' request to redact the highlighted portions of the supporting documents containing email addresses, telephone numbers). Further, [f]ederal law generally treats medical records as confidential. Hand v. N.Y. City Transit Auth., No. 11-CV-997 RRM MDG, 2012 WL 3704826, at *5, 2012 U.S. Dist. LEXIS 120701, at *18 (E.D.N.Y. Aug. 26, 2012) (citing Health Insurance Portability and Accountability Act of 1996 (HIPAA), Pub.L. 104191 (1996)). Given the limited scope of Defendants request to seal Exhibits B and G, and the narrowly tailored redactions from Exhibits A, E, F, and G, the Court finds that the privacy interests of the affected individuals outweigh the presumption of public access (see Amodeo, 71 F.3d at 1050 ("[t]he privacy interests of innocent third parties... should weigh heavily in a court's balancing equation.") (internal quotation marks omitted)), and that the sealing and redaction of these documents is essential to preserve higher values. United States v Erie Cnty., 763 F.3d 235, 239 (2d Cir. 2014).
