An FTCA complaint must allege the ways in which employees of the federal government are liable to plaintiffs under state tort law. Here, the plaintiffs alleged that the EPA was liable for negligence in two instances related to statutory duties: first, because it failed to bring a Section 1431 Emergency Action under the Safe Drinking Water Act until 2016, despite being on notice as early as October 2014 that there was a potential problem of toxic water in Flint; and second, because the EPA failed to provide advice and technical assistance to states and local providers which are not in compliance with the requirements of the Safe Water Drinking Act. They also alleged that the EPA was negligent in not warning the public of potential risks to public health due to the contamination of Flint's water, and that they were negligent in undertaking a timely investigation of the situation in Flint.

The plaintiffs filed an amended complaint on February 2, 2018. In response to the complaint, the government filed a motion to dismiss on March 2, 2018, arguing that it had not waived its immunity from the plaintiffs’ claims because Michigan law would not impose liability on private individuals in similar circumstances–which is the extent to which the FTCA only waives government immunity–and because the alleged misconduct by the EPA is excepted from liability under the FTCA’s discretionary function exception. Mediation proceedings were ongoing for about a year, and the plaintiffs filed a second amended complaint on February 8, 2019.

On April 18, 2019, Judge Parker issued an order and opinion denying the government's motion to dismiss, finding that even if Michigan law would not impose liability on private individuals, the discretionary exception is not applicable under the circumstances of the case. Judge Parker also found that the plaintiffs plead facts sufficient to justify liability under applicable state law, thereby allowing their case to proceed.

On June 7, 2019, the government filed a motion to certify interlocutory appeal, seeking to immediately appeal Judge Parker’s order denying the government’s motion to dismiss. This motion was denied by Judge Parker on September 27, 2019 for two reasons. First, the court’s decision was too fact-intensive an inquiry for interlocutory review: it required the court to dig deeply into the factual record and, at this stage of the proceedings, the facts were still developing and future discovery may impact the court’s analysis. Second, the court did not believe that an immediate appeal would expedite resolution of this case, and instead, denying the motion may advance settlement discussions and an ultimate resolution of the numerous lawsuits arising from the Flint water crisis. 2019 WL 4734686.

The government filed an answer to the second amended complaint on December 6, 2019. The case was consolidated with several others in an order entered on March 3, 2020. The consolidated cases represent 7,535 plaintiffs in total. Judge Parker appointed Deborah Greenspan, a partner in Blank Rome's Washington, D.C. office, as a special master for the now-consolidated action In re FTCA Flint Water Cases on March 25, 2020.

On March 24, 2021, the United States moved to dismiss a number of plaintiffs from the case. The parties’ March 2, 2020 Stipulated Case Management Order 3 (CMO No. 3) established protocols for conducting Bellwether proceedings in this case, including requiring plaintiffs randomly selected by the special master to complete fact sheets and authorize the release of specific records and documents. CMO No. 3 also outlined procedures for addressing incomplete fact sheets, allowing the United States to move to dismiss the plaintiffs with prejudice if such deficiencies were not rectified through these procedures. The United States sought to dismiss several plaintiffs for failing to provide complete fact sheets. Judge Parker denied this motion on December 20, 2021 because there was no evidence that these plaintiffs were deliberately disregarding their obligations. Instead, Judge Parker recognized various factors potentially impacting these plaintiffs’ responsiveness, including the economic challenges hindering their ability to access and transmit information, and that these difficulties were exacerbated by the COVID-19 pandemic. Judge Parker also noted that since there were no impending trial dates or other court-imposed deadlines being delayed due to the incomplete fact sheets, the United States had not suffered any prejudice.

On May 26, 2023, the parties filed a stipulated order directing one of the named plaintiffs, individually and behalf of minor child P.F., to participate in Bellwether discovery as set forth in Stipulated Case Management Order 4 (CMO No. 4), or that their claims be dismissed with prejudice. On July 20, 2023, the United States moved to dismiss plaintiffs Laurie Fuller and P.F. from the action because they refused to participate in discovery. Judge Parker granted this motion on July 21, 2023.
