On November 20, 2019, a formerly incarcerated individual filed a putative class action lawsuit in the U.S. District Court for the Eastern District of New York. The plaintiff alleged negligence by Microgenics Corporation and its parent company, Thermo Fischer Scientific Corporation. The plaintiff sought to represent “all persons who obtained positive testing results for Suboxone/buprenorphine generated by Indiko Plus urinalysis analyzers while in the New York State Department of Corrections and Community Supervision custody in 2019”. Represented by Prisoners Legal Services and the civil rights firm Emery Celli Brinckerhoff & Abady, the plaintiff alleged that the defendants’ failure to ensure that their urinalysis machines were providing accurate and reliable test results led to false positives on in-prison drug tests. Consequently, affected prisoners were wrongly punished, through solitary confinement, loss of visitation rights, and in some cases held “well-beyond their release dates,” in violation of the Eighth and Fourteenth Amendments of the U.S. Constitution and the New York State Business Law. The complaint further alleged that current and former New York State Department of Corrections and Community Supervision [DOCCS] employees failed to stop testing in a timely fashion and refused and delayed remedial action in violation of the Eighth and Fourteenth Amendments of the U.S. Constitution. The plaintiff sought punitive and compensatory damages as well as attorneys’ fees and costs. The case was assigned to District Judge Frederic Block and Magistrate Judge Vera M. Scanlon.

On January 10, 2020, the defendants filed a motion for a pre-motion conference to seek permission to file a motion to dismiss. On January 29, 2020, Magistrate Judge Scanlon held a conference and provided the scheduling order for the case.

On March 5, 2020, the plaintiff filed her first amended complaint, which provided additional facts regarding the defendants’ alleged failure to comply with applicable drug testing standards and failure to ensure that their testing was accurate and reliable.

On March 23, 2020, the defendants filed a motion to stay discovery. Two days later, on March 25, 2020, the court denied the defendants’ motion to stay discovery.

On June 15, 2020, the defendants filed a motion to dismiss the first amended complaint for failure to state a claim. Microgenics claimed that it did not owe a duty directly to the plaintiff, Microgenics had not breached any such duty if it did exist, and class adjudication should be struck due to impracticability. Thermo Fisher claimed it was not a party to the contract between Microgenics and DOCCS, on which the plaintiff based her claims.

For approximately the next year, the parties engaged in discovery. On March 22, 2021, the court denied the defendants’ motion to dismiss the first amended complaint. 2021 WL 1109052. The court held that the plaintiff plausibly alleged that the defendants owed her a duty of care and plausibly alleged that the defendants breached their duty of care. Additionally, the plaintiff sufficiently alleged Thermo Fisher’s liability. The court also declined to dismiss the plaintiff’s class allegations at this juncture, deferring consideration of class standing questions to the class certification stage. 

On April 15, 2021, the plaintiff filed her second amended complaint. In the second amended complaint, the plaintiff added additional facts regarding the defendants’ contract with DOCCS to provide urinalysis analyzers to 52 correctional facilities from September 1, 2018 to August 31, 2023. The plaintiff also asserted new causes of action for alleged constitutional and consumer-protection violations. The plaintiff included a second cause of action under § 1983, alleging Microgenics “facilitate[ed] and enable[ed], and even actively and substantially encourag[ed]” the imposition of disciplinary sanctions on the plaintiff based on her false positive drug screen, thereby subjecting the plaintiff to cruel and unusual punishment in violation of the Eighth and Fourteenth Amendments. The plaintiff included a third cause of action under § 1983, contending Microgenics’ alleged facilitation of unwarranted discipline violated her substantive due process rights under the Fourteenth Amendment. Finally, the plaintiff included a fourth cause of action under New York state law’s consumer protection for Microgenics’ alleged use of “deceptive acts and practices” in its distribution of urinalysis products.

On August 10, 2021, the defendants filed a motion to dismiss for failure to state a claim for the newly alleged constitutional and consumer-protection causes of action. On March 10, 2022, the court denied the defendants’ motion to dismiss.

Discovery in this case proceeded, though with significant delay caused by the coronavirus pandemic. This delay, coupled with DOCCS’s delays in production and the investigation of the issues by the New York State Office of the Inspector General, caused the delay in filing the third amended complaint, which was filed March 30, 2022. The third amended complaint added an additional plaintiff, who was previously in the custody of DOCCS, as well as individually named eight DOCCS employees as defendants. The plaintiffs brought two additional causes of action against the eight DOCCS employees under § 1983 for cruel and unusual punishment under the Eighth and Fourteenth Amendments and for violations of substantive due process under the Fourteenth Amendment.  

On June 29, 2022, the case was reassigned to Magistrate Judge Darryl Schultz.

The DOCCS defendants filed a motion to dismiss for failure to state a claim and on qualified immunity grounds on August 5, 2022. The court granted in part and denied in part the DOCCS employees’ motions to dismiss on March 31, 2023. The court dismissed the Eighth Amendment claim against all eight employees and denied the motion to dismiss as to the Fourteenth Amendment substantive due process claim for four of the employees, finding that qualified immunity did not shield four of the eight employees. On April 26, 2023, the court reaffirmed its order granting in part and denying in part the DOCCS employees’ motion to dismiss. 2023 WL 3081290. The court held that deliberate indifference to arbitrary punishment could constitute a substantive due process violation under the plaintiffs’ § 1983 claim, and that plaintiffs sufficiently alleged failure to investigate complaints of arbitrary punishment made by plaintiffs for qualified immunity to not apply at this stage.

On April 28, 2023, one of the DOCCS employees appealed the court’s denial of dismissal. More appeals from other DOCCS employees followed. The defendants also sought to stay discovery while the interlocutory appeals were pending, and on May 19, 2023, two of the named defendants who had served as DOCCS Acting Commissioner and Deputy Commissioner, respectively, filed a cross claim against Microgenics.

On March 20, 2023, Microgenics and Thermo Fischer also filed a motion to dismiss and strike the plaintiffs’ class allegations. On June 13, 2023, the court granted Microgenics and Thermo Fishers’ motion to dismiss with respect to the Eighth Amendment claims with prejudice and denied the motion as to all other claims. The court found that the plaintiffs had sufficiently alleged conscience-shocking, deliberate indifference as to whether the tests were sufficiently reliable to serve as the sole basis for inmate discipline. On Microgenics’ effort to strike class allegations, the court found that the pleading stage was an inappropriate juncture to make a judgment on the plaintiffs’ class allegations, a decision better suited to after a filing for class certification.

On June 21, 2023, the court denied two of the DOCCS employees’ motions for a protective order, and their motion to stay the case pending appeal. 2023 WL 6283249. Additionally, on September 26, 2023, the court granted in part and denied in part the motion of two DOCCS employees to stay their depositions. The court held that the plaintiffs may depose them as non-parties with respect to the claims that were not on interlocutory appeal.

On September 8, 2023, the defendants filed a motion for reconsideration of the court’s order on June 13, 2023 regarding Microgenics and Thermo Fishers’ motion to dismiss. On January 23, 2024, the court denied the defendants’ motion for reconsideration of the court’s order on the motion to dismiss. 2024 WL 245301. The court held that it did not err in finding Microgenics and Thermo Fischer could be liable under § 1983 because the plaintiffs plausibly alleged “state action under the public function test.” The court also held that a motion for reconsideration was an improper mechanism for the court to consider Microgenics and Thermo Fischer’s arguments that they did not directly participate in the alleged constitutional deprivations and that they are entitled to qualified immunity since Microgenics and Thermo Fischer failed to raise these arguments in their motion to dismiss. Finally, the court held that the plaintiffs sufficiently pled under state law direct injury that did not rely on injuries sustained by others. As of March 26, 2024, this case remains ongoing.

ORDER The motion for a stay at 37 is denied, and the motion to compel discovery at 34 is denied for the reasons stated on the record. In brief, counsel are expected to adapt the litigation process to the exigencies of the COVID-19 pandemic. Per the representations of Defendants' counsel, given his clients' participation in the health care industry, and response to the pandemic, communications with the clients are delayed. Accordingly, it is presently difficult for Defendants' counsel to consult fully with his clients. At the same time, because discovery was already underway when the pandemic developed, Defendants' counsel is already in possession of some of the discovery materials that will be produced. As an adaptation to the current circumstances, limited discovery will proceed at this time. Defendants will make a complete production of the Wilkie/Carter materials as available. No other discovery will be produced before 6/26/2020. In the intervening period, counsel are expected to discuss what future ESI requests will be, including any adjustments for the expanded amended complaint. Counsel should work to develop an ESI protocol, recognizing that the opportunity to refine the agreement by Defendants running test searches may be limited for the time being. The subpoena to DOCS is stayed until at least 6/26/2020. By that date, Plaintiffs may request that the subpoena proceed. Any permission to proceed will take into account the then-present demands on the correctional services in light of the pandemic. Counsel for Plaintiff is to provide a copy of this Order to DOCS and file proof of service by 4/8/2020.The motion for a pre-motion conference is granted to the extent today's conference was held. The briefing for the motion to dismiss is as follows: Defendants' moving papers to be served by 4/24/2020; Plaintiffs' opposition to be served by 5/22/2020; Defendants' reply to be served by 6/12/2020. Counsel are requested to extend the Court the courtesy of filing only the fully briefed motion by 6/19/2020. If additional time is needed to complete the briefing, counsel may propose an amended schedule. ORDER denying 41 Motion for Discovery. In light of the COVID-19 pandemic and the demands on New York State authorities, the Court adheres to its decision to stay discovery against DOCCS until June 26, 2020. For the same reasons, the stay is extended to any subpoena issued to the NYS Office of the Inspector General. For the same reasons, discovery as to any governmental agency is stayed until 6/26/2020 unless there is a substantial improvement in current circumstances such that discovery would not place an undue burden on the government agency. As to Alere Toxicology, there is no information in the record as to the impact of the pandemic on this entity. To the extent the pandemic limits its ability to respond to the subpoena, it may apply to stay or quash the subpoena. Plaintiff's counsel is to serve a copy of this Order on the NYS Attorney General's Office and Alere Toxicology, and file proof of service by 4/9/2020. Ordered by Magistrate Judge Vera M. STATUS REPORT ORDER: As discussed during the 7/29/2020 conference, the parties' proposed stipulated e-discovery plan [49-1] is so ordered. On or before 9/24/2020, the parties are to revise and resubmit their proposed protective order [49-2] as follows: First, delete all references to a Disclosing Party's ability to mark discovery "Highly Confidential-Attorney's Eyes Only" and related special handling. See, e.g., [49-2], paragraphs 4, 11. The deletions are necessary because the proposed confidentiality order is overbroad and may make discovery unwieldy in that Plaintiff would be limited in their ability to review relevant discovery with their clients. If a Disclosing Party later finds protections for "Confidential" discovery insufficient as to specific information, the Disclosing Party may at that time enter into a specific agreement with the other parties or make an application to the Court raising the particular issue. Second, the revised text must contain a provision requiring a Disclosing Party producing discovery marked "Confidential" to simultaneously deliver a second set of that discovery to the Receiving Party on which the Disclosing Party has specifically redacted the purportedly sensitive information. The parties are reminded that awaiting the entry of a confidentiality order is not an excuse for the parties to delay the timely production of discovery covered by the parties own confidentiality agreement. The parties are also reminded that discovery is not stayed in this action during the pendency of the motions to dismiss. To the extent that the involved government agencies face difficulties producing discovery because of the COVID-19 pandemic, they should discuss their concerns with the parties' counsel, and if they are unable to come to a production agreement, they should timely raise the issue with the Court. Should the parties be interested in discussion settlement with a mediator, they may request a referral to the Court's mediation program by submitting a joint request for a referral to the Court's ADR program.
