On August 10, 2020 the Cook County Republican Party brought this lawsuit against the Governor of Illinois, various board members of the Illinois Board of Elections, the Cook County Clerk, and the Commissioners of the Chicago Board of Elections. Represented by the Liberty Justice Center, the plaintiffs alleged that SB 1863, an Illinois law which had been signed into effect and provided for millions of Illinois voters to receive mail-in ballot applications in light of the COVID-19 pandemic, was a partisan scheme to dilute Republican ballots and harvest Democratic ballots in order to sway the election results. Filing under 42 U.S.C. § 1983 and 28 U.S.C. § 2201, the plaintiffs claimed their First and Fourteenth Amendment rights had been violated and requested declaratory and injunctive relief to stop SB 1863 from going into effect. Specifically, they alleged that SB 1863 would lead to fraudulent votes being counted as well as ballots being collected by individuals who would not turn them in, which would lead to voter disenfranchisement. The case was assigned to Judge Robert M. Dow, Jr. and Magistrate Judge M. David Weisman.

Simultaneous with the complaint, the plaintiffs filed for a preliminary injunction, claiming that failure to enjoin SB 1863 from going into effect before the November 2020 election would cause irreparable harm to their fundamental right to vote, due to vote dilution and voter fraud. Because the ballot applications had been already mailed, the plaintiffs requested the remaining provisions of SB 1863 be immediately enjoined, including: provisions allowing ballot harvesting, making election day a paid holiday for government workers, provisions regarding the counting of fraudulent signatures and the appointment of election judges, and provisions allowing 14 days to cure a defective provisional ballot. 

On August 25, the Democratic Congressional Campaign Committee (DCCC) moved to intervene as a defendant, which the court granted on August 28 without objection.

On September 4, various defendants filed motions to dismiss and motions in opposition to the plaintiffs' preliminary injunction request. They argued the plaintiffs did not have standing to seek relief and that they were not entitled to a preliminary injunction. Related to the plaintiff's specific allegations, they argued that arguments that SB 1863 violated the Illinois Constitution was barred by the Eleventh Amendment and that its allegations of First or Fourteenth Amendment violations were weak because the plaintiffs had not identified any "restriction" caused by SB 1863, but were claiming that the lack of restrictions would lead to voter fraud. Furthermore, defendants argued that if the court entered an injunction, it would place substantial burdens to the 108 election authorities across the state because the plaintiffs had waited so long to seek relief n court, since the election authorities were supposed to mail ballots within the next 3 weeks. 

On September 17, 2020, Judge Dow, Jr. denied the motion for preliminary injunction. 487 F. Supp. 3d 704. The court reasoned that the plaintiff had provided "no basis for concluding that its alleged harms are anything but speculative," thus they had not proved irreparable harm was likely in absence of an injunction. Additionally, each of the plaintiff's specific claims were unlikely to succeed on the merits, as the ballot harvesting claim was based on a misreading of SB 1863, that the decision to provide 14 days to cure provisional ballots was within the authority of the legislature, that making election day a paid government holiday was in the legislature's prerogative to build in flexibility for polling locations, and that the "legislature's judgment to enact additional measures to encourage voting by mail during a pandemic facilitates the state interest of limiting crowds at polling places for those who are comfortable voting in person while providing a viable alternative for those are not."

The plaintiffs filed a voluntary dismissal on September 23, which Judge Dow, Jr. granted on September 24. The case is now closed.
