This is a case about the constitutionality of Nevada's signature-gathering requirements for ballot initiatives during the COVID-19 pandemic.

Near the end of 2019, a political action committee called Fair Maps Nevada filed a ballot initiative that would amend the Nevada Constitution to provide for the establishment of an independent redistricting commission. After social distancing measures were implemented at the beginning of the pandemic, the organization discovered that it would be unable to gather the required number of signatures in person by the pre-election deadline of June 24, 2020.

On May 6, 2020, three Nevada voters and Fair Maps Nevada filed a lawsuit in the U.S. District Court for the District of Nevada against the Nevada Secretary of State and one county election official from each of the state's seventeen counties. The plaintiffs claimed that the Secretary's insistence on in-person signatures offended their rights to vote and to engage in political speech, as guaranteed by the Nevada Constitution and the First and Fourteenth Amendments of the U.S. Constitution. Represented by private counsel, the plaintiffs sought declaratory and injunctive relief and attorneys' fees.

With their complaint, the plaintiffs also moved for a preliminary injunction that would push back the signature submission deadline and prevent the defendants from requiring in-person signatures. They also filed a motion to expedite briefing regarding the preliminary injunction. The next day, Judge Miranda M. Du granted the motion to expedite.

On May 15, the Secretary filed a motion to dismiss. Over the following days, the county defendants joined that motion. That same week, a private individual and a different political action committee, Nevada Resort Association, filed a motion to intervene as defendants. The proposed intervenors claimed that the relief requested by the plaintiffs would jeopardize the integrity of the state's ballot initiative process. They also claimed that only private individuals could challenge ballot initiatives under Nevada's statutory scheme, and that the plaintiffs' proposed injunction would interfere with individuals' ability to do so. The next week, on May 20, 2020, the court granted the motion to intervene. 2020 WL 8188427. 

On May 29, 2020, the court denied the defendants' motion to dismiss and granted in part and denied in part the plaintiffs' motion for a preliminary injunction. Judge Du applied strict scrutiny and declared that the statute's June 24 deadline was unconstitutional as applied to these plaintiffs in the context of the pandemic. She left in place the in-person signature requirements. 463 F. Supp. 3d 1123.

The parties entered into a consent decree in which they agreed upon a new deadline: August 3, 2020. They also agreed that the complaint would be dismissed with the court's approval of the decree on June 9, 2020, and they agreed that each party would cover its own fees and costs.
