This is a case about mail-in voting during the COVID-19 pandemic. On June 29, 2020, the Donald Trump Presidential Campaign, the Republican National Committee, four Republican members of the U.S. House of Representatives from Pennsylvania, and two residents of Pennsylvania filed this suit in the U.S. District Court for the Western District of Pennsylvania. These plaintiffs, represented by a private law firm, sued Pennsylvania and its county boards of elections under 42 U.S.C. § 1983, alleging that the state’s voting policies had violated the First and Fourteenth Amendments and Articles I and II of the U.S. Constitution, as well as portions of the Pennsylvania State Constitution and Pennsylvania state law. The plaintiffs sought declaratory relief, both preliminary and permanent injunctions, and attorney’s fees. The case was heard by District Judge J. Nicholas Ranjan.

The plaintiffs alleged that Pennsylvania Secretary of State Kathy Boockvar had implemented various changes to the voting system for the 2020 elections that violated Pennsylvania state law, the Pennsylvania Constitution, and the U.S. Constitution. The main changes the plaintiffs focused on were policies increasing the locations where people could return mail-in ballots and decreasing the scrutiny that mail-in ballot applications were previously subject to. According to the plaintiffs, these changes were likely to lead to widespread voter fraud that would dilute valid votes with invalid ones and therefore infringe the voting rights of Pennsylvania’s citizens. Some of these policies had been implemented in the state’s 2020 primary elections, and the plaintiffs asked the court to stop the state from implementing them in the November 2020 general election.

The plaintiffs’ claims were primarily focused on no-excuse mail-in voting, which had been put into place by the Pennsylvania state legislature in 2019. According to the plaintiffs, Secretary Boockvar gave the county boards of elections guidance about the mail-in voting process that violated the state’s existing election law, as well as the U.S. Constitution and the Pennsylvania Constitution. First, the plaintiffs alleged that the drop-off boxes where people could return mail-in ballots would lead to voter fraud and ballot harvesting, in which a third party gathers and returns other people’s ballots. Second, the plaintiffs argued that Boockvar’s guidance allowed people to receive mail-in ballots without proper examination of their credentials. Third, they claimed that Boockvar’s guidance permitted the counting of ballots that were not properly concealed in an outer envelope. Fourth, they alleged that Boockvar gave incorrect instructions about people who try to vote in-person after they have already been sent a mail-in ballot, and they claimed that some people had voted twice in the primary. Finally, the plaintiffs argued that voter fraud could occur due to a lack of monitoring by campaign poll watchers, both because poll watchers could not monitor the delivery and processing of mail-in ballots and because of a Pennsylvania state law that only let poll watchers work in the county where they live. Some of these claims were added or expanded upon in an amended complaint filed about a month after the initial complaint.

There were a few different federal constitutional arguments underlying the plaintiffs’ claims. First, they argued that Secretary Boockvar could not legally implement these voting policies because state legislatures are in charge of federal election administration according to Articles I and II of the U.S. Constitution. Second, they argued that by making the elections less secure, these policies violated the voting rights that are guaranteed by the First and Fourteenth Amendments. Finally, they argued that the inconsistencies between the way different Pennsylvania counties carried out Boockvar’s guidance amounted to disparate treatment, which violates the Equal Protection Clause of the Fourteenth Amendment. The plaintiffs also claimed that the election policies violated the Pennsylvania State Constitution, which protects fair elections and outlaws disparate treatment.

As the case progressed, various organizations, such as the NAACP and the League of Women Voters, joined the defendants’ side using motions to intervene. On August 23, 2020, the court stayed the case, granting in part various motions to dismiss by the defendants and intervenors. 481 F. Supp. 3d. 476. The court held that the question of whether Secretary Boockvar’s policies had violated state election law was essential to the case, and that a state court would be better suited to interpret state law than a federal court. Citing the Pullman abstention doctrine, the court decided to pause the case until state courts clarified various aspects of Pennsylvania’s election laws.

Five days after the abstention order, the plaintiffs asked the court for a preliminary injunction that would stop election officials from mixing mail-in ballots from drop boxes with those that were returned in other ways. They argued that by the time the case was resolved, it might be too late to separate out the allegedly invalid drop-box ballots from the valid ballots. However, the court denied the motion because no ballots had been counted yet, and the state courts would probably rule soon on this issue. 2020 WL 5407748.

On September 17 of the same year, the Pennsylvania Supreme Court ruled on Pennsylvania Democratic Party v. Boockvar, a case that settled some of the issues of state law that the court in this case had abstained from deciding. 238 A.3d 345. Therefore, on the same day, the court in this case lifted its stay because it could now properly evaluate the plaintiffs’ claims. Six days later, the court dismissed some of the plaintiffs’ claims because it ruled that the state Supreme Court case had resolved them. It also noted that certain state law issues had not been resolved by Pennsylvania Democratic Party v. Boockvar, and that it was still proper to abstain on questions about poll watchers monitoring drop boxes, 2020 WL 5658392, or how officials should evaluate mail-in ballot applications, 2020 WL 6737648. On the same day, the plaintiffs amended their complaint to add a new claim that officials were not properly checking the signatures on mail-in ballots.

On October 10, 2020, the court granted summary judgment for the defendants. 493 F. Supp. 3d 331. First of all, the court held that it was unnecessary to rule on some issues that had been previously resolved. For instance, the Pennsylvania Supreme Court had ruled that ballots had to be rejected if they did not have an outer envelope, and Secretary Boockvar had changed the policy on voting in-person by those who already were sent a mail-in ballot. The court ruled only on whether people could take their ballots to drop boxes, whether officials needed to reject mail-in ballots based on signature matching, and whether poll watchers could work in counties where they did not live.

The court ruled that the plaintiffs did not have standing to sue because they had not demonstrated that concrete harm would come from the state’s election policies. The potential for voter fraud that the plaintiffs had pointed to was only speculation based on various assumptions, and the plaintiffs did not show that vote dilution would actually happen or that different policies would stop it. Furthermore, the court noted that beyond issues of standing, the plaintiffs’ arguments would not have succeeded anyway. Firstly, it ruled that a policy that slightly raised the chance of fraud was not enough to count as an infringement of voting rights, and the state government had the right to decide how elections should be held. Secondly, small differences in policies between counties or between voting methods was acceptable, and the potential increased fraud did not count as disparate treatment because fraud would dilute everyone’s vote equally. Additionally, the policy guidance given by Secretary Boockvar was state-wide, so it was not itself discriminatory. Ultimately, the court held that election policy was in the purview of elected officials, not federal judges. The court did not rule on the claims about the Pennsylvania State Constitution.

The judgment for defendants was not appealed, so the case is closed.
