This case arose out of the 2020 election in Rhode Island. This case arose out of the 2020 election in Rhode Island. On June 16, 2020, candidates for the Rhode Island Senate ("the plaintiffs") filed this lawsuit in the U.S. District Court for the District of Rhode Island alleging that Rhode Island state law that required potential candidates to engage in-person solicitation and receipt of signatures and an in-person witness violated the First and Fourteenth Amendments to the U.S. Constitution in the context of the COVID-19 pandemic. The plaintiffs sued members of the Boards of Canvassers in Central Falls, North Providence, Pawtucket, Providence, and Warwick; the clerk and/or registrar of the Boards of Canvassers in the same cities; the Administrators and/or Directors of Elections in Providence and Warwick; the Rhode Island Secretary of State; members of the Rhode Island Board of Elections; and Rhode Island's Attorney General. Represented by the ACLU of Rhode Island, the plaintiffs sought declaratory and injunctive relief.

Specifically, the plaintiffs alleged that the ballot qualification process for the 2020 election placed candidates who were not incumbents at a distinct disadvantage because those candidates would have to rely on in-person canvassing and thus would needlessly exposes candidates, their supporters, and the general public to risks associated with COVID-19 when safer alternatives were available.

In their complaint, the plaintiffs proposed an alternative electronic ballot qualification process where voters executed nomination petitions through email or electronic transmission. Thus, the plaintiffs requested the court grant emergency injunctive relief in the form of suspending Rhode Island's candidate qualification process for the 2020 election.

On June 25, 2020, Judge Mary S. McElroy granted the plaintiffs' motion "to the extent that it [sought] a one-time cessation of the in-person signature requirement and instead call[ed] for the collection of signatures electronically." 470 F. Supp. 3d. 161.

The parties entered a stipulation of dismissal on September 1, 2020, and the case was dismissed. This case is now closed.
