On June 10, 2021, three residents of Baltimore with mobility disabilities and the IMAGE Center of Maryland sued the Mayor and City Council of Baltimore in the U.S. District Court for the District of Maryland. The plaintiffs, represented by lawyers from three disability rights groups and private counsel, proceeded under Title II of the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act. The lawsuit sought a court order requiring Baltimore to ensure its sidewalks and streets are accessible to people with mobility disabilities and that future sidewalks and city projects comply with accessibility laws. In addition, the plaintiffs sought class certification to represent all people with a mobility disability who live in, work in, or will visit the City of Baltimore.The case was assigned to Magistrate Judge Beth P. Gesner and reassigned to Chief Judge James K. Bredar on July 8, 2021.

Initial attempts at settlement failed, and on April 21, 2022, Judge Bredar ordered settlement-related discovery to begin. On August 8, 2022, Judge Bredar vacated all deadlines other than settlement-related discovery deadlines.

In an opinion filed on January 13, 2025, the court granted a joint motion for Preliminary Approval of a partial consent decree. The judge granted class certification for the more than 50,000 people with ambulatory difficulties in the Baltimore area. The terms of the decree included installation of accessible curb ramps at existing corners of Baltimore’s pedestrian right away, and remediation of non-compliant existing curb ramps and pedestrian walkways. The decree dictated the amounts of money Baltimore must spend between curb ramps and sidewalks during the fiscal years 2025-26, 2026-27, and 2027-28. If Baltimore received additional highway revenue in excess of what it anticipates in any given year, the city must commit additional funding. The decree also required additional programs and activities to remediate walkways. The parties agreed to meet and confer about alternatives should Baltimore become unable to fulfill its obligation. Service awards of $10,000 were granted to each named Plaintiff, and Defendant agreed to pay plaintiffs' reasonable ongoing attorneys’ fees subject to an annual $100,000 cap.

The court granted the motion and stated that it would set further dates and deadlines by order.  

In an opinion on March 31, 2025, Judge Bredar granted three pending motions: a motion for $10,000 in service awards to each of four named plaintiffs; a motion for attorneys' fees and costs, awarding $1,168,830.75 in attorneys' fees and $6,357.55 in costs; and a joint motion for final approval of the partial consent decree previously described. The decree only partially resolved the litigation, with the court to retain jurisdiction and the parties to begin negotiating a plan to remediate all remaining curb ramps and pedestrian walkways twelve months before the decree's expiration. 

Implementation is ongoing.
