Case Summary

This is a case about immigration policy that restricted refugee and asylum entry into the United States on account of health concerns around the coronavirus pandemic. On January 12, 2021, families of asylum- and refugee-seekers, who were detained by the Department of Homeland Security, sued the U.S. federal government for humanitarian protection in the U.S. District Court for the District of Columbia. With the spread of coronavirus, on March 20, 2020, the Department of Health and Human Services (HHS) restricted entry of foreign nationals. Under the alleged authority of Title 42 U.S.C. § 265 (“Title 42 Process”), the federal government contended that it had the power to set aside immigration laws and began to summarily expel asylum-seeking families. This policy was renewed multiple times, including on August 2, 2021. The families alleged violations of the Public Health Service Act, Refugee Act, Foreign Affairs Reform and Restructuring Act of 1998, Immigration and Nationality Act, and Administrative Procedure Act. On behalf of the more broadly impacted community (the families estimated more than 21,000 individuals had been subject to the HHS order), the families sought class certification. They also sought a declaration that the Title 42 Process as implemented by the government was unlawful, an injunction preventing the government from applying the Title 42 Process to the class, and reasonable attorneys’ fees.

The case was assigned to Judge Emmett G. Sullivan. On September 16, 2021, the court certified the class and granted the preliminary injunction. Huisha-Huisha v. Mayorkas, 560 F.Supp.3d 146. The class was defined as: "“All noncitizens who (1) are or will be in the United States; (2) come to the United States as a family unit composed of at least one child under 18 years old and that child’s parent or legal guardian; and (3) are or will be subjected to the Title 42 Process.” In certifying the class, the court pushed back on the government’s argument that the class had been insufficiently defined. First, the court asserted that as a matter of law, a “vague and ambiguous class definition” was not automatically fatal to a motion for class certification. Moreover, based on the details provided by the plaintiffs, the court found the class definition sufficient in any case. In ruling for the preliminary injunction, the court highlighted why the families were likely to succeed on the merits. The court first noted that the plain text of Title 42 contained no reference to the word “expel” or other synonyms, suggesting that the statute’s use to remove asylee- and refugee-seekers from the U.S. was untenable. The court also analyzed the statutory context and found it indicated that HHS only had limited “quarantine and containment” powers under the Title 42 Process.

The federal government appealed the decision. On September 30, 2021 the Court of Appeals for the D.C. Circuit granted the government’s motion for a stay of the injunction pending appeal.

Meanwhile, in the district court, the parties submitted several status reports outlining their positions regarding next steps in the litigation. The plaintiffs also filed a Second Amended Complaint, which updated facts that had become outdated (such as the names of defendants) and included the operative Title 42 Order.

In an opinion issued on March 4, 2022, the D.C. Circuit affirmed the district court’s preliminary injunction against enforcement of the Title 42 Process with respect to the class of plaintiffs. The D.C. Circuit agreed that the plaintiffs were likely to succeed on the merits of their claim that they could not be removed to countries in which they would be persecuted or tortured, pursuant to both the INA and the Convention Against Torture (CAT). The court also held that the district court did not abuse its discretion in determining that plaintiffs would suffer irreparable injury absent a preliminary injunction and that the balance of equities weighed in plaintiffs’ favor. However, the court also found that plaintiffs were not likely to succeed on the merits of their claim that they could not be expelled from the country before they had an opportunity to apply for asylum – nonetheless, this argument would still deserve attention from the district court when it considered the merits.

Back in the district court, the parties submitted an additional joint status report on March 25, 2022. The report stated that the CDC was going to conduct a reassessment of the Title 42 Process, and that the outcome of the potentially modified order could influence the parties’ respective recommendations for next litigation steps. The CDC issued its report on April 1, 2022, announcing the end of the Title 42 policy by concluding that current public health conditions and an increased availability of tools to fight COVID-19 rendered the order unnecessary. The termination was to be implemented on May 23, 2022, however, the District Court for the Western District of Louisiana preliminarily enjoined the termination order on May 20 in Louisiana v. CDC, causing the policy to remain in effect. 603 F.Supp.3d 406. The government appealed the decision enjoining the termination order to the Fifth Circuit.

The parties submitted joint reports for the next several months. On August 10, 2022, plaintiffs filed a section motion for a preliminary injunction. Two days later, the court issued an order converting the section motion to a motion for partial summary judgment and consolidated the motion with a determination of whether Title 42 was arbitrary and capricious under §706 of the Administrative Procedure Act (APA). Plaintiffs submitted their motion for partial summary judgment on August 15, 2022.

On November 15, 2022, the court issued an opinion granting plaintiffs’ motion for partial summary judgment. The Court vacated and set aside the Title 42 policy, declaring it arbitrary and capricious in violation of the APA, and permanently enjoined the government and their agents from applying the policy to plaintiffs. The court found the policy to be arbitrary and capricious because the CDC failed to 1) impose the least restrictive means necessary to prevent the spread of disease, 2) explain their departure from the least restrictive means standard and 3) adequately consider alternatives. The same day, the government filed an unopposed motion to stay the order. The federal government requested the stay for a temporary period, in order to prepare the logistical details for the transition period after Title 42 ended. The court granted the stay, though it stated that it was doing so with great reluctance. The order was stayed for five weeks and was set to take effect at midnight on December 21, 2022.

A week later, on November 22, the court issued an order entering partial final judgment in favor of plaintiffs on their claim that Title 42 was arbitrary and capricious under the APA. That same day, 15 states (Arizona, Louisiana, Alabama, Alaska, Kansas, Kentucky, Mississippi, Nebraska, Ohio, Oklahoma, South Carolina, Texas, Virginia, West Virginia, and Wyoming) filed a motion to intervene. The intervening states argued that the government had originally defended Title 42, but then shifted course when they agreed with plaintiffs to end the policy on December 21, abandoning their defense of the policy. They sought to intervene on the basis that an invalidation of the Title 42 policy would harm them and they wanted to offer a defense of the policy since the government were no longer doing so. In the following few days, Montana, Utah, Missouri, and Tennessee sought to join the 15 intervening states, which the court permitted. On December 7, 2022, the government appealed two orders: 1) the November 15 order vacating Title 42 and 2) the November 22 order entering partial final judgment on behalf of the plaintiffs, on the basis that Title 42 was lawful, and the court had erred in vacating the policy. The government informed the court of its intention to move the D.C. Circuit to hold the appeal in abeyance pending the Fifth Circuit’s decision in Louisiana v. CDC. Two days later, on December 9, the intervening states filed a motion to stay the November 22 order pending appeal, which the court denied, citing the same reasons listed in the opinion issued on November 15.

On December 19, 22, two days before the order vacating Title 42 was set to go into effect, the U.S. Supreme Court issued a stay, pending their decision on whether to hear the case. 2022 WL 17750015. Fewer than ten days later, on December 27, the Supreme Court stayed the order pending hearings in February, where it would hear arguments on whether the states may intervene. 143 S.Ct. 478. Had the order gone into effect, the policy would have been set aside and no migrants encountered at the border would have been expelled. Many would have likely requested asylum, and been entitled to a full review of their cases. Given the Supreme Court’s decision, however, the stay and Title 42 remain in place, allowing migrant expulsion to continue.

In its December 27 decision, the Supreme Court requested the parties to treat the order as a grant of writ of certiorari on the specific question of whether the state applicants may intervene to challenge the district court’s summary judgment order. 143 S.Ct. 478. Although the parties continued to submit briefings on the matter to the court, on May 12, 2023, the Solicitor General submitted a letter to the Supreme Court notifying that the Title 42 order had expired as the public health emergency had expired on May 11. The Solicitor General, thus, requested that the court vacate the court of appeals’ order denying intervention and remand with instructions to dismiss the motion as moot. The Supreme Court then issued judgment accordingly on June 20, 2023. 143 S.Ct. 1312.

Come September 7, 2023, following the Supreme Court’s decision, the D.C. Appellate Court vacated the motion to intervene. At the appellate level, the defendants had also filed a motion to vacate the district court’s judgment and remand the case for dismissal. The defendants noted here too that the Title 42 order had expired. Thus, along with its vacature of the motion to intervene, the D.C. Circuit granted the defendants’ motion to vacate the district court judgment as well. The court also ordered the case be dismissed as moot within the same September 7 order.

Ultimately, the D.C. District Court dismissed the case as moot in light of the Appellate Court’s order on November 8, 2023. This case is now closed.
