On January 8, 2019, four individuals with disabilities filed a class action complaint against the City of San Diego, Bird Rides, Inc, Neutron Holdings, Inc. d/b/a LIME, Razor USA LCC, Uber Technologies, Inc., Lyft, Inc, Wheels Labs, Inc. alleging the City and the dockless vehicle defendants have allowed sidewalks, street crossings, transit stops, crosswalks, curb cuts and other walkways to be blocked by unused scooters in violation of Title II and Title III of the Americans with Disabilities Ac…

On January 8, 2019, four individuals with disabilities filed a class action complaint against the City of San Diego, Bird Rides, Inc, Neutron Holdings, Inc. d/b/a LIME, Razor USA LCC, Uber Technologies, Inc., Lyft, Inc, Wheels Labs, Inc. alleging the City and the dockless vehicle defendants have allowed sidewalks, street crossings, transit stops, crosswalks, curb cuts and other walkways to be blocked by unused scooters in violation of Title II and Title III of the Americans with Disabilities Act (ADA) and the Rehabilitation Act of 1973 and California law. On March 21, 2019, Plaintiffs filed, and later amended, their complaint in the U.S. District Court for the Southern District of California, where it was assigned to District Judge Jeffery T. Miller.

The city and the scooter companies moved to dismiss the First Amended Complaint. On Jan. 21, 2020, the court denied the city’s motion to dismiss. The Court granted the scooter companies motions to dismiss rejecting that plaintiffs arguments that the sidewalks were a place of public accommodation under ADA Title III and scooter companies had an obligation to keep them accessible.

On April 15, 2020, plaintiffs filed a Second Amended Complaint against just the City of San Diego alleging the City had allowed sidewalks, street crossings, transit stops, crosswalks, curb cuts and other walkways to be blocked by unused scooters in violation of Title II of the ADA and the Rehabilitation Act of 1973 and California law.

On October 2, 2020, plaintiffs moved for a preliminary injunction arguing that local ordinances passed by the city had made the blocking of sidewalks by scooter worse and necessitating a preliminary injunction.

On January 29, 2021, plaintiffs moved for class certification.

On March 18, 2021, the court denied the motion for a preliminary injunction finding that the 2 year delay in moving for a preliminary injunction uncut their claims and finding that plaintiffs failed to establish irreparable injury rather than some inconvenience.

On June 9, 2021 the court denied the motion for class certification.  On July 9, 2021, plaintiffs made a renewed motion for class certification with a narrower and more defined class definition. On October 20, 2021, the court denied without prejudice plaintiffs renewed motion for class certification due to concerns about waiving damages claims and notice to class members. On October 27, 2021, the court denied the City’s motion for judgment on the pleadings on two California state law claims.

On February 1, 2022, the parties reached settlement facilitated by Magistrate Judge Bernard G. Skomal.  The court dismissed the lawsuit without prejudice on September 12, 2022.
