The Ada County Coroner, in his official capacity, and Ada County initially filed this lawsuit in the Idaho District Court of the Fourth Judicial Circuit against Disability Rights Idaho- Idaho’s P&A. On September 17, 2014, Disability Rights Idaho removed the case to the U.S. District Court for the District of Idaho because it concerned the federal Protection and Advocacy for Individuals with Mental Illness Act (PAIMI Act), and filed a counterclaim against the Ada County Coroner. Both the Ada County Coroner and Disability Rights Idaho filed Motions for Summary Judgement. The Ada County Coroner sought declarative relief that they were not required to provide Disability Rights Idaho with death investigation records under the PAIMI Act, and that providing the records would violate Idaho law. Disability Rights Idaho sought injunctive relief that declared the Ada County Coroner were required to provide the death investigation records in question under the PAIMI Act, and that they had a private right of action for recovery under 42 U.S.C. § 1983. The plaintiffs were represented by the Ada County Prosecutor’s office, and Disability Rights represented itself. Judge Edward J. Lodge presided over the case.

 

Both Motions for Summary Judgment hinged upon whether Disability Rights Idaho’s records access authority during an investigation included death investigation records from the Ada County Coroner. On March 7, 2016, the court granted Disability Rights Idaho’s motion in part, and denied Ada County and the Ada County Coroner’s motion. The court rejected Ada County’s argument that they did not need to disclose death investigation records because they were not a “facility” under the PAIMI Act. The court determined that P&As may access records concerning suspected abuse or neglect that occurred at a facility, regardless of whether the records were from the facility itself. The court also determined that the Ada County Coroner’s office is an agency conducting investigations under and subject to records requests under PAIMI Act. Moreover, the court rejected the Ada County’s argument that disclosing these records without obtaining consent from the decedent’s parents would subject them to liability under Idaho law. The court explained that the decedent’s parents were not his legal guardian or representative, so Disability Rights Idaho did not need their consent to receive the records under the PAIMI Act, and that the PAIMI Act pre-empted any Idaho laws that subjected plaintiffs to liability. The court held that Ada County and the Ada County Coroner violated the PAIMI Act, and issued permanent injunction requiring that the Ada County Coroner comply with subsequent records requests concerning this investigation and any future records requests by Disability Rights Idaho that complied with the PAIMI Act. The court rejected Disability Rights Idaho’s claims for relief under 42 U.S.C. § 1983 because only private Protection and Advocacy agencies could receive relief under 42 U.S.C. § 1983, and that they can already receive relief under the PAIMI Act.
