Plaintiffs filed suit in federal court on April 19, 2016, requesting compensatory and punitive damages, attorney fees and costs, injunctive relief to end a landlord's disability discrimination and a declaration that the landlord violated the housing discrimination and related state laws. Hon. William T. Lawrence of the U.S. District Court, Southern District of Indiana, Indianapolis Division, presided over the case.

The Plaintiffs in this case were the Fair Housing Center of Central Indiana, Inc. (a non-profit fair housing agency) and a personal representative of the Estate of the individual plaintiff. They were represented by Indiana Protection & Advocacy Services and the Law Firm of Brancart & Brancart, Pescadero, California. The Defendants were the landlord and the landlord's trust, owners of the apartment building where plaintiff lived.  At the close of the case, Defendants were represented by Monday Jones & Albright of Indianapolis.  

Per the complaint, the individual plaintiff, a person with a disability, was at home recuperating from an illness when her landlord repeatedly entered her apartment and demanded that she move out. The landlord made these demands because the plaintiff was using a hospital bed and was perceived by the landlord as needing to be in “a facility.” The landlord initiated eviction proceedings. At the eviction hearing, landlord stated that she wanted plaintiff out of the apartment because she had a disability. The Fair Housing Center of Central Indiana helped contest the eviction on their investigation, they found evidence of both disability and family-based discrimination. The eviction was not successful and the plaintiffs sued the landlord and the family trust that owned the building, for disability and family-based discrimination under the federal Fair Housing Act as well as state law and tort claims. The court issued a default judgment against the landlord in the plaintiffs’ favor.

On or around December 12, 2016, plaintiff died and her daughter was substituted as a plaintiff in the action. Plaintiffs filed a Motion for Partial Summary Judgment on May 19, 2017, and on August 31, 2017, landlord Defendant’s counsel withdrew. The court issued an order for the appointment of counsel by Oct. 2, 2017 due to the need for the family trust to be represented by counsel.  On December 7, 2017, the court ordered the entry of a default against landlord, in her capacity as trustee of the Family Trust, due to her failure to provide counsel.  The court then held a damages hearing on March 16, 2018, at which defendants or counsel did not appear.  

On July 3, 2018, the court held a hearing on Plaintiffs’ Motions for Entry of Default Judgment. The court granted the motions and awarded the Plaintiffs damages, attorney fees, and costs.  The court awarded the following:  1) $25,000 compensatory damages and $50,000 punitive damages to Plaintiff Jessica Carlton; 2)  $11,501.82 compensatory damages and $34,505.46 in punitive damages to Fair Housing Center of Central Indiana; 3)  attorney's fees in the amount of $40,199.50 for the work performed by Brancart & Brancart and $55,015.00 for work performed by attorneys at Indiana Disability Rights and 4) $3,525.97, in costs and expenses incurred by attorneys at Indiana Disability Rights.

The Court ordered  injunctive relief as follows: 1) The defendants shall not discriminate in any respect in the rental of dwellings; 2) the defendants adopt implement a policy prohibiting discrimination on the basis of disability on any residential properties landlord or the Family Trust owns; 3) the defendants adopt and implement a written policy prohibiting discrimination on the basis of familial status in any residential properties  landlord or the Family Trust owns; and 4) the defendants remove the “Adults Only” sign and maintain a fair housing sign in a form approved by the United States Department of Housing and Urban Development.

On Sept. 24, 2018, the defendants, through new counsel, filed a Motion to Set Aside the Judgment, which the court denied on Jan. 11, 2019.  Defendant landlord died in December 2020.

ENTRY ON MOTIONS FOR DEFAULT JUDGMENT - This cause is before the Court on the Plaintiffs' Motions for Entry of Default Judgment Dkt. Nos. 39 & 72 . The Court held a hearing on the motions on March 12, 2018; the Defendants were given notice of the hearing but did not appear. The Plaintiffs also have filed a motion for attorney fees and costs Dkt. No. 83 . The Court, being duly advised, GRANTS the motions and awards the Plaintiffs damages, attorney fees, and costs as set forth below. Given the Court's findings, set forth above, judgment will be entered in this case in favor of the Plaintiffs and against the Defendants. Damages in the amount of $25,000 compensatory damages and $50,000 punitive damages are awarded to Plaintiff Jessica Carlton. Damages in the amount of $11,501.82 compensatory damages and $34,505.46 in punitive damages are awarded to Plaintiff Fair Housing Center of Central Indiana. The Court awards attorney's fees in the amount of $95,214.50 in fees, which include $40,199.50 for the work performed by Brancart & Brancart and $55,015.00 for work performed by attorneys at Indiana Disability Rights. Further, the Court has reviewed the costs and expenses sought by Plaintiffs' counsel and, finding them to be reasonably incurred, awards $3,525.97, which represents $3,398.83 in costs and expenses incurred by Brancart & Brancart and $127.14 in costs and expenses incurred by attorneys at Indiana Disability Rights.
