This case considered whether a psychiatric hospital could refuse or ignore a Protection and Advocacy agency’s (P&A) request for death investigation records of a former hospital patient who did not have a guardian, conservator, or legal representative. On December 22, 2006, Indiana P&A Services (Indiana P&A), filed this lawsuit in U.S. District Court for the Southern District of Indiana. Indiana P&A filed this lawsuit against Indiana Family and Social Services Administration, as well the Indiana Secretary of the Family and Social Services Administration, Indiana Director of the Division of Mental Health and Addiction, and the Superintendent of LaRue Memorial Hospital in their respective official capacities. Represented by itself, Indiana P&A sought the disclosure of a mortality peer review committee report and a root cause analysis that concerned a former patient at a state-operated psychiatric hospital. Indiana P&A alleged that the defendants violated the Protection and Advocacy for Individuals with Mental Illness Act (PAIMI Act), when they denied its requests for these records. Judge Larry J. McKinney presided over the matter. 

On July 28, 2008, the court granted Indiana P&A’s Monition for Summary Judgment. The court determined that Indiana P&A did not need the deceased patient’s parents to consent to their records request. Because the parents were not their adult child’s legal guardian, conservator, or legal representative, the PAIMI Act permitted Indiana P&A to receive these records. Moreover, the court held that the mortality peer review committee report and the root cause analysis are records based on federal regulations interpreting the PAIMI Act. 42 C.F.R. § 51.41(c)(1). The defendants appealed the case to the U.S. Court of Appeals for Seventh Circuit. On April 22, 2010, the en banc Seventh Circuit court the scope of the district court's judgment to the named defendants in this lawsuit but affirmed the substance of the Summary Judgment decision. 2008 WL 11375366; Indiana Protection and Advocacy Services v. Indiana Family and Social Services Admin., 603 F.3d 365 (7th Cir. 2010).
