Case Summary

(This summary is temporary, while we research the case.) This class action case was filed in the Federal District Court for the Eastern District of Michigan, on June 6, 2018, by the Michigan Protection and Advocacy system.  The case was assigned to District Judge Thomas L. Ludington and Magistrate Judge Patricia T. Morris.  The lawsuit alleged violations of the Medicaid Early and Periodic Screening, Diagnostic and Treatment act, the Americans with Disabilities Act, and Section 504 of the Rehabilitation Act. There was a mutual interim agreement stipulated to on August 4, 2020 and as revised on November 23, 2021, on April 25, 2022, and August 2, 2022. A December 2021 settlement  with the State agreeing to spend $91 million to provide appropriate community-based services and supports for youth with mental health care needs in foster care. The motion for certifying the class was granted in favor of the plaintiffs on November 3, 2022.
