The case began after plaintiff was excluded from a drug treatment program provided by the New York State Department of Corrections and Community Supervision (DOCCS), due to his disabilities. The plaintiff had a number of disabilities, including a seizure disorder and heart conditions. He applied to join a drug treatment program in the DOC called SHOCK, which consists of physical exercise and work therapy along with education, and had been recommended, but not ordered, by his sentencing judge. Successful completion of the program conferred benefits on participants, including extra good time credits and the possibility of earlier release. He was denied on the basis that he was not medically fit to participate. The DOC had an alternate program for people who were court ordered to the program but could not meet the physical demands -- the Comprehensive Alcohol & Substance Abuse Treatment (CASAT). However, CASAT was not made available to volunteers like the plaintiff; only to those who had been court-ordered to participate. The plaintiff filed multiple grievances throughout his term of incarceration protesting his exclusion from the program, and Disability Rights New York filed an investigation on his behalf in 2017. When DRNY’s advocacy did not alter the DOC’s eligibility determination, the plaintiff served a notice of intention to file a claim on the attorney general on December 23, 2017. 

On Jan. 23, 2019, a month after plaintiff's initial release from incarceration, plaintiff brought this suit under the Americans with Disabilities Act (ADA) and 42 U.S.C. § 1983. He named multiple officers of DOCCS in both their individual and official capacities, and requested compensatory and punitive damages and declaratory relief.  Following an initial filing in the Eastern District of New York, where the plaintiff resided at the time of filing (following his release from incarceration; he has subsequently been re-incarcerated due to parole violations), the case was moved to the Northern District of New York, the proper venue for the defendants and the jurisdiction in which the plaintiff was incarcerated. Once removed, the case was before Judge David N. Hurd. The plaintiff initially filed pro se and in forma pauperis. Disability Rights New York later joined as plaintiff’s counsel. 

Defendants filed a motion to dismiss on December 6, 2019. On March 31, 2020, the court ruled that his § 1983 claims against DOCCS and the individual defendants in their official capacities were dismissed, as were the ADA claims against individual defendants, but the § 1983 claims against the individual defendants in their individual capacities and Count II ADA claim against DOCCS could proceed.

The plaintiff thereafter filed an amended complaint on June 30, 2021. Discovery disputes took place throughout 2022, and on April 30, 2023 the plaintiff filed a motion for summary judgment. Litigation continued; most recently with defendants objections to plaintiff’s request for an extension of page limit in further filings in relation to the motion for summary judgment following defendant’s challenges to it, on July 25, 2023.  On March 26, 2024 the court denied cross motions for summary judgment and indicated that the plaintiff's three claims—under the ADA, the Rehabilitation Act, and § 1983—remain for trial but certain individual defendants were dismissed. 

As of April 2024, the case is ongoing.

ORDER TO SHOW CAUSE: Plaintiff's 2 Motion for Leave to Proceed in forma pauperis is granted. However, the court has concerns regarding whether venue in this district is proper considering that the individual defendants reside in, and the facility at issue is located in, Greene County, New York, which sits in the Northern District of New York. See 28 U.S.C. § 112(a). A substantial part of the events giving rise to plaintiff's claims occurred in the Northern District. (See ECF No. 1, Compl.) The court also understands that all the individual defendants, and the witnesses and evidence the parties will rely on to prove their claims and defenses, are located in that District. See N. Y. Mar. and Gen. Ins. Co. v. Lafarge N. Am., Inc. 599 F.3d 102, 112 (2d Cir. 2010). Therefore, plaintiff is ORDERED to show cause, by written submission to this court, no later than May 17, 2019, why this matter should not be transferred to the Northern District of New York pursuant to 28 U.S.C. § 1404(a), in the interests of justice and for the convenience of the parties and witnesses.
